1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by
5changing Section 9-158 as follows:
 
6    (40 ILCS 5/9-158)  (from Ch. 108 1/2, par. 9-158)
7    Sec. 9-158. Proof of disability, duty and ordinary. Proof
8of duty or ordinary disability shall be furnished to the board
9by at least one licensed and practicing physician appointed by
10or acceptable to the board, except that this requirement may
11be waived by the board for proof of duty disability if the
12employee has been compensated by the county for such
13disability or specific loss under the Workers' Compensation
14Act or Workers' Occupational Diseases Act. The physician
15requirement may also be waived by the board for ordinary
16disability maternity claims of up to 8 weeks. With respect to
17duty disability, satisfactory proof must be provided to the
18board that the final adjudication of the claim required under
19subsection (d) of Section 9-159 established that the
20disability or death resulted from an injury incurred in the
21performance of an act or acts of duty. The board may require
22other evidence of disability. Each disabled employee who
23receives duty or ordinary disability benefit shall be examined

1at least once a year or a longer period of time as determined
2by the board, by one or more licensed and practicing
3physicians appointed by the board. When the disability ceases,
4the board shall discontinue payment of the benefit.
