AMENDMENT TO HOUSE BILL 222

2    AMENDMENT NO. ______. Amend House Bill 222 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 3-802 and by adding Section 3-699.22 as
6follows:
 
7    (625 ILCS 5/3-699.22 new)
8    Sec. 3-699.22. Defense Superior Service plates. The
9Secretary, upon receipt of an application made in the form
10prescribed by the Secretary, may issue special registration
11plates designated as Defense Superior Service license plates
12to Illinois residents who have been awarded the Defense
13Superior Service Medal by a branch of the armed forces of the
14United States. The special plates issued pursuant to this
15Section shall be affixed only to passenger vehicles of the
16first division, motorcycles, and motor vehicles of the second

1division weighing not more than 8,000 pounds. The Secretary
2may allow the plates to be issued as vanity or personalized
3plates in accordance with Section 3-405.1. The Secretary shall
4make a version of the special registration plates authorized
5under this Section in a form appropriate for motorcycles. The
6design and color of the plates shall be wholly within the
7discretion of the Secretary. No registration fee, including
8the fees established under Section 3-806, shall be charged for
9the issuance or renewal of any plates issued under this
10Section.

12    Sec. 3-802. Reclassifications and upgrades.
13    (a) Definitions. For the purposes of this Section, the
14following words shall have the meanings ascribed to them as
15follows:
16        "Reclassification" means changing the registration of
17    a vehicle from one plate category to another.
18        "Upgrade" means increasing the registered weight of a
19    vehicle within the same plate category.
20    (b) When reclassing the registration of a vehicle from one
21plate category to another, the owner shall receive credit for
22the unused portion of the present plate and be charged the
23current portion fees for the new plate. In addition, the
24appropriate replacement plate and replacement sticker fees
25shall be assessed.

1    (b-5) Any Beginning with the 2019 registration year, any
2individual who has a registration issued under either Section
33-405 or 3-405.1 that qualifies for a special license plate
4under Section 3-609, 3-609.1, 3-620, 3-621, 3-622, 3-623,
53-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650,
63-651, 3-664, 3-666, 3-667, 3-668, 3-669, 3-676, 3-677, 3-680,
73-681, 3-683, 3-686, 3-688, 3-693, 3-698, 3-699.12, or
83-699.17, or 3-699.22 may reclass his or her registration upon
9acquiring a special license plate listed in this subsection
10(b-5) without a replacement plate or digital plate fee or
11registration sticker or digital registration sticker cost.
12    (b-10) Any Beginning with the 2019 registration year, any
13individual who has a special license plate issued under
14Section 3-609, 3-609.1, 3-620, 3-621, 3-622, 3-623, 3-624,
153-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650, 3-651,
163-664, 3-666, 3-667, 3-668, 3-669, 3-676, 3-677, 3-680, 3-681,
173-683, 3-686, 3-688, 3-693, 3-698, 3-699.12, or 3-699.17, or
183-699.22 may reclass his or her special license plate upon
19acquiring a new registration under Section 3-405 or 3-405.1
20without a replacement plate or digital plate fee or
21registration sticker or digital registration sticker cost.
22    (c) When upgrading the weight of a registration within the
23same plate category, the owner shall pay the difference in
24current period fees between the 2 two plates. In addition, the
25appropriate replacement plate and replacement sticker fees
26shall be assessed. In the event new plates are not required,

1the corrected registration card fee shall be assessed.
2    (d) In the event the owner of the vehicle desires to change
3the registered weight and change the plate category, the owner
4shall receive credit for the unused portion of the
5registration fee of the current plate and pay the current
6portion of the registration fee for the new plate, and in
7addition, pay the appropriate replacement plate and
8replacement sticker fees.
9    (e) Reclassing from one plate category to another plate
10category can be done only once within any registration period.
11    (f) No refunds shall be made in any of the circumstances
12found in subsection (b), subsection (c), or subsection (d);
13however, when reclassing from a flat weight plate to an
14apportioned plate, a refund may be issued if the credit
15amounts to an overpayment.
16    (g) In the event the registration of a vehicle registered
17under the mileage tax option is revoked, the owner shall be
18required to pay the annual registration fee in the new plate
19category and shall not receive any credit for the mileage
20plate fees.
21    (h) Certain special interest plates may be displayed on
22first division vehicles, second division vehicles weighing
238,000 pounds or less, and recreational vehicles. Those plates
24can be transferred within those vehicle groups.
25    (i) Plates displayed on second division vehicles weighing
268,000 pounds or less and passenger vehicle plates may be

1reclassed from one division to the other.
2    (j) Other than in subsection (i), reclassing from one
3division to the other division is prohibited. In addition, a
4reclass from a motor vehicle to a trailer or a trailer to a
5motor vehicle is prohibited.
