SYNOPSIS AS INTRODUCED:

105 ILCS 5/34-18.7  from Ch. 122, par. 34-18.7

    Amends the School Code. With regard to the in-service training program on the warning signs of mental illness and suicidal behavior in youth, provides that the program must utilize evidence-based training that educates the participants on (i) recognizing the signs and symptoms of mental illness and substance use disorders, including common psychiatric conditions such as schizophrenia, bipolar disorder, major clinical depression, and anxiety disorders and common substance use disorders such as opioids and alcohol, (ii) providing referrals to mental health or substance use disorder services or other support to individuals in the early stages of developing a mental illness or substance use disorder, recommending resources available in the community for individuals with a mental illness or substance use disorder, and recommending any other relevant resources, and (iii) ensuring the safe de-escalation of crisis situations involving individuals with a mental illness. Provides that a school district may utilize the Mental Health First Aid training program to provide the training.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Sections
510-22.39 and 34-18.7 as follows:
 
6    (105 ILCS 5/10-22.39)
7    Sec. 10-22.39. In-service training programs.
8    (a) To conduct in-service training programs for teachers.
9    (b) In addition to other topics at in-service training
10programs, at least once every 2 years, licensed school
11personnel and administrators who work with pupils in
12kindergarten through grade 12 shall be trained to identify the
13warning signs of mental illness and suicidal behavior in youth
14and shall be taught appropriate intervention and referral
15techniques. The training program must utilize evidence-based
16training that educates the participants on all of the
17following:
18        (1) Recognizing the signs and symptoms of mental
19    illness and substance use disorders, including common
20    psychiatric conditions such as schizophrenia, bipolar
21    disorder, major clinical depression, and anxiety disorders
22    and common substance use disorders such as opioids and
23    alcohol.

1        (2) Providing referrals to mental health or substance
2    use disorder services or other support to individuals in
3    the early stages of developing a mental illness or
4    substance use disorder, recommending resources available
5    in the community for individuals with a mental illness or
6    substance use disorder, and recommending any other
7    relevant resources.
8        (3) Ensuring the safe de-escalation of crisis
9    situations involving individuals with a mental illness.
10A school district may utilize the Mental Health First Aid
11training program, which is administered by certified
12instructors trained by a national association recognized as an
13authority in behavioral health, to provide the training and
14meet the requirements under this subsection.
15    (c) School guidance counselors, nurses, teachers and other
16school personnel who work with pupils may be trained to have a
17basic knowledge of matters relating to acquired
18immunodeficiency syndrome (AIDS), including the nature of the
19disease, its causes and effects, the means of detecting it and
20preventing its transmission, and the availability of
21appropriate sources of counseling and referral, and any other
22information that may be appropriate considering the age and
23grade level of such pupils. The School Board shall supervise
24such training. The State Board of Education and the Department
25of Public Health shall jointly develop standards for such
26training.

1    (d) In this subsection (d):
2    "Domestic violence" means abuse by a family or household
3member, as "abuse" and "family or household members" are
4defined in Section 103 of the Illinois Domestic Violence Act of
51986.
6    "Sexual violence" means sexual assault, abuse, or stalking
7of an adult or minor child proscribed in the Criminal Code of
81961 or the Criminal Code of 2012 in Sections 11-1.20, 11-1.30,
911-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, 12-12,
1012-13, 12-14, 12-14.1, 12-15, and 12-16, including sexual
11violence committed by perpetrators who are strangers to the
12victim and sexual violence committed by perpetrators who are
13known or related by blood or marriage to the victim.
14    At least once every 2 years, an in-service training program
15for school personnel who work with pupils, including, but not
16limited to, school and school district administrators,
17teachers, school guidance counselors, school social workers,
18school counselors, school psychologists, and school nurses,
19must be conducted by persons with expertise in domestic and
20sexual violence and the needs of expectant and parenting youth
21and shall include training concerning (i) communicating with
22and listening to youth victims of domestic or sexual violence
23and expectant and parenting youth, (ii) connecting youth
24victims of domestic or sexual violence and expectant and
25parenting youth to appropriate in-school services and other
26agencies, programs, and services as needed, and (iii)

1implementing the school district's policies, procedures, and
2protocols with regard to such youth, including
3confidentiality. At a minimum, school personnel must be trained
4to understand, provide information and referrals, and address
5issues pertaining to youth who are parents, expectant parents,
6or victims of domestic or sexual violence.
7    (e) At least every 2 years, an in-service training program
8for school personnel who work with pupils must be conducted by
9persons with expertise in anaphylactic reactions and
10management.
11    (f) At least once every 2 years, a school board shall
12conduct in-service training on educator ethics,
13teacher-student conduct, and school employee-student conduct
14for all personnel.

17    Sec. 34-18.7. Youth mental illness and suicide detection
18and intervention. At least once every 2 years, licensed school
19personnel and administrators who work with pupils in
20kindergarten through grade 12 shall be trained to identify the
21warning signs of mental illness and suicidal behavior in youth
22and shall be taught various intervention techniques. The
23training program must utilize evidence-based training that
24educates the participants on all of the following:

1    illness and substance use disorders, including common
2    psychiatric conditions such as schizophrenia, bipolar
3    disorder, major clinical depression, and anxiety disorders
4    and common substance use disorders such as opioids and
5    alcohol.
6        (2) Providing referrals to mental health or substance
7    use disorder services or other support to individuals in
8    the early stages of developing a mental illness or
9    substance use disorder, recommending resources available
10    in the community for individuals with a mental illness or
11    substance use disorder, and recommending any other
12    relevant resources.
13        (3) Ensuring the safe de-escalation of crisis
14    situations involving individuals with a mental illness.
15The school district may utilize the Mental Health First Aid
16training program, which is administered by certified
17instructors trained by a national association recognized as an
18authority in behavioral health, to provide the training and
19meet the requirements of this Section. The Such training shall
20be provided within the framework of existing in-service
21training programs offered by the Board or as part of the
22professional development activities required under Section
2321-14 of this Code.
