SYNOPSIS AS INTRODUCED:

110 ILCS 805/2-27 new
30 ILCS 805/8.44 new

    Amends the Board of Higher Education Act and the Public Community College Act. Provides that the Board of Higher Education and the Illinois Community College Board shall require each board of trustees of public universities and community colleges in this State to establish a minimum salary for instructors that is not less than $1,333.33 per credit hour taught. Allows the minimum salary to be subject to an increase based upon a cost of living adjustment. Requires an annual report concerning compliance with minimum salary requirements. Provides that nothing in the provisions shall prevent the paying of instructors at a higher rate than the required minimum salary. Defines "public university board of trustees". Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5adding Section 17 as follows:
 
6    (110 ILCS 205/17 new)
7    Sec. 17. Public university minimum salary.
8    (a) For the purposes of this Section, "public university
9board of trustees" means the Board of Trustees of the
10University of Illinois, the Board of Trustees of Southern
11Illinois University, the Board of Trustees of Chicago State
12University, the Board of Trustees of Eastern Illinois
13University, the Board of Trustees of Governors State
14University, the Board of Trustees of Illinois State University,
15the Board of Trustees of Northeastern Illinois University, the
16Board of Trustees of Northern Illinois University, the Board of
17Trustees of Western Illinois University, and any other board of
18trustees of a public university now or hereafter established or
19authorized by the General Assembly.
20    (b) The Board of Higher Education shall require each public
21university board of trustees in this State to establish a
22minimum salary for instructors at public institutions of higher
23education that is not less than $1,333.33 per credit hour

1taught. The minimum salary set under this Section may, from
2time to time, be subject to an increase based upon a cost of
3living adjustment.
4    (c) Each public university board of trustees shall annually
5report to the Board its compliance with the minimum salary
6requirements of this Section, including a detailed listing of
7the salary of each instructor employed by that public
8institution of higher education.
9    (d) Nothing in this Section shall prevent a public
10university board of trustees from paying instructors employed
11by those public institutions of higher education at a higher
12rate than the minimum salary established under this Section.
 
13    Section 10. The Public Community College Act is amended by
14adding Section 2-27 as follows:
 
15    (110 ILCS 805/2-27 new)
16    Sec. 2-27. Community college minimum salary.
17    (a) The Illinois Community College Board shall require each
18board of trustees of a public community college district in
19this State to establish a minimum salary for instructors at
20community colleges that is not less than $1,333.33 per credit
21hour taught. The minimum salary set under this Section may,
22from time to time, be subject to an increase based upon a cost
23of living adjustment.
24    (b) Each Board shall annually report to the State Board its

1compliance with the minimum salary requirements of this
2Section, including a detailed listing of the salary of each
3instructor employed by that community college.
4    (c) Nothing in this Section shall prevent a Board from
5paying instructors employed by those community colleges at a
6higher rate than the minimum salary established under this
7Section.
 
8    Section 90. The State Mandates Act is amended by adding
9Section 8.44 as follows:
 
10    (30 ILCS 805/8.44 new)
11    Sec. 8.44. Exempt mandate. Notwithstanding Sections 6 and 8
12of this Act, no reimbursement by the State is required for the
13implementation of any mandate created by this amendatory Act of
14the 101st General Assembly.
