AMENDMENT TO HOUSE BILL 2816

2    AMENDMENT NO. ______. Amend House Bill 2816 by replacing
3line 16 on page 3 through line 5 on page 4 with the following:
 
4"discretion of the court. No legal fees, appointed counsel
5fees, guardian ad litem fees, or costs shall be assessed
6against the Office of the State Guardian, the public guardian,
7an adult protective services agency, the Department of Children
8and Family Services, or the agency designated by the Governor
9under Section 1 of the Protection and Advocacy for Persons with
10Developmental Disabilities Act. If the respondent is unable to
11pay the fee of the guardian ad litem or appointed counsel, or
12both, the court may enter an order for the petitioner to pay
13all such fees or such amounts as the respondent or the
14respondent's estate may be unable to pay. However, in cases
15where the Office of State Guardian is the petitioner,
16consistent with Section 30 of the Guardianship and Advocacy
17Act, where the public guardian is the petitioner, consistent

1with Section 13-5 of this Act, where an adult protective
2services agency is the petitioner, pursuant to Section 9 of the
3Adult Protective Services Act, or where the Department of
4Children and Family Services is the petitioner under
5subparagraph (d) of subsection (1) of Section 2-27 of the
6Juvenile Court Act of 1987, no guardian ad litem or legal fees
7shall be assessed against the Office of State Guardian, the
8public guardian, the adult protective services agency, or the
9Department of Children and Family Services.".
