SYNOPSIS AS INTRODUCED:

820 ILCS 130/11c new

    Amends the Prevailing Wage Act. Provides that the Act does not apply to wages paid to all laborers, workers, and mechanics employed by or on behalf of a public body engaged in a public works project with a total cost of $20,000 or less if the public body notifies the Department of Labor of each project for which the waiver is used within 60 days of commencing the project. Provides that the Department shall make available a form with which public bodies may make this notification. Provides that the Department shall submit an annual report detailing the number of projects engaged using the waiver in the preceding year, the total number of employees engaged in those projects, the total cost of those projects without using prevailing wage standards, the total cost of those projects using prevailing wage standards, and any other information the Department deems appropriate. Effective immediately.

1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Prevailing Wage Act is amended by adding
5Sections 1a and 11c as follows:
 
6    (820 ILCS 130/1a new)
7    Sec. 1a. Waiver. This Act does not apply to wages paid to
8all laborers, workers, and mechanics employed by or on behalf
9of any and all public bodies engaged in public works projects
10with a total cost of $20,000 or less for a "stand-alone"
11project (a project that will not have additional work within
12the next 24 months) if public bodies using this waiver notify
13the Department of Labor of each project for which the waiver is
14used within 60 days of commencing the project. The Department
15of Labor shall make available a form with which public bodies
16may make such notification, which includes a description of the
17project, the number of employees engaged in the project, the
18total cost of the project without using prevailing wage
19standards, the total cost of the project using prevailing wage
20standards, and any other reasonable information the Department
21of Labor deems appropriate. The waiver available under this
22Section is available only to the extent permitted under federal
23law and regulations.

2    Sec. 11c. Reports. The Department of Labor shall submit to
3the Governor and General Assembly an annual report no later
4than January 31 of each year beginning in 2021 detailing the
5number of projects engaged using the waiver in Section 1a of
6this Act in the preceding year, the total number of employees
7engaged in those projects, the total cost of those projects
8without using prevailing wage standards, the total cost of
9those projects using prevailing wage standards, and any other
10information the Department of Labor deems appropriate.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
