AMENDMENT TO HOUSE BILL 1638

2    AMENDMENT NO. ______. Amend House Bill 1638 on page 1 by
3replacing line 5 with the following:
 
4"changing Sections 5-2.1d and 5-4.2 as follows:
 
5    (305 ILCS 5/5-2.1d)
6    Sec. 5-2.1d. Retroactive eligibility. An applicant for
7medical assistance may be eligible for up to 3 months prior to
8the date of application if the person would have been eligible
9for medical assistance at the time he or she received the
10services if he or she had applied, regardless of whether the
11individual is alive when the application for medical assistance
12is made. In determining financial eligibility for medical
13assistance for retroactive months, the Department shall
14consider the amount of income and resources and exemptions
15available to a person as of the first day of each of the
16backdated months for which eligibility is sought. The

1Department shall receive the approval of the General Assembly
2prior to applying for a waiver to reduce or eliminate the
3State's authority to grant eligibility for up to 3 months prior
4to the date of application.
