SYNOPSIS AS INTRODUCED:
 
755 ILCS 65/50

    Amends the Disposition of Remains Act. Provides that any dispute concerning the right to control the disposition of a decedent's remains shall be resolved by a court within 30 days of the dispute being filed with the court.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Disposition of Remains Act is amended by
5changing Section 50 as follows:
 
6    (755 ILCS 65/50)
7    Sec. 50. Disputes. Any dispute among any of the persons
8listed in Section 5 concerning their right to control the
9disposition, including cremation, of a decedent's remains
10shall be resolved by a court of competent jurisdiction within
1130 days of the dispute being filed with the court. A cemetery
12organization or funeral establishment shall not be liable for
13refusing to accept the decedent's remains, or to inter or
14otherwise dispose of the decedent's remains, until it receives
15a court order or other suitable confirmation that the dispute
16has been resolved or settled.
