AMENDMENT TO HOUSE BILL 124

2    AMENDMENT NO. ______. Amend House Bill 124 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Police Act is amended by changing
5Section 9 as follows:
 
6    (20 ILCS 2610/9)  (from Ch. 121, par. 307.9)
7    Sec. 9. Appointment; qualifications.
8    (a) Except as otherwise provided in this Section, the
9appointment of Department of State Police officers shall be
10made from those applicants who have been certified by the Board
11as being qualified for appointment. All persons so appointed
12shall, at the time of their appointment, be not less than 21
13years of age, or 20 years of age and have successfully
14completed an associate's degree or 60 credit hours 2 years of
15law enforcement studies at an accredited college or university.
16Any person appointed subsequent to successful completion of an

1associate's degree or 60 credit hours at an accredited college
2or university 2 years of such law enforcement studies shall not
3have power of arrest, nor shall he or she be permitted to carry
4firearms, until he or she reaches 21 years of age. In addition,
5all persons so certified for appointment shall be of sound mind
6and body, be of good moral character, be citizens of the United
7States, have no criminal records, possess such prerequisites of
8training, education, and experience as the Board may from time
9to time prescribe, and shall be required to pass successfully
10such mental and physical tests and examinations as may be
11prescribed by the Board. Notwithstanding any Board rule to the
12contrary, all persons who meet one of the following
13requirements are deemed to have met the collegiate educational
14requirements:
15        (i) have been honorably discharged and who have been
16    awarded a Southwest Asia Service Medal, Kosovo Campaign
17    Medal, Korean Defense Service Medal, Afghanistan Campaign
18    Medal, Iraq Campaign Medal, or Global War on Terrorism
19    Expeditionary Medal by the United States Armed Forces;
20        (ii) are active members of the Illinois National Guard
21    or a reserve component of the United States Armed Forces
22    and who have been awarded a Southwest Asia Service Medal,
23    Kosovo Campaign Medal, Korean Defense Service Medal,
24    Afghanistan Campaign Medal, Iraq Campaign Medal, or Global
25    War on Terrorism Expeditionary Medal as a result of
26    honorable service during deployment on active duty;

1        (iii) have been honorably discharged who served in a
2    combat mission by proof of hostile fire pay or imminent
3    danger pay during deployment on active duty; or
4        (iv) have at least 3 years of full active and
5    continuous military duty and received an honorable
6    discharge before hiring.
7    Preference shall be given in such appointments to persons
8who have honorably served in the military or naval services of
9the United States. All appointees shall serve a probationary
10period of 12 months from the date of appointment and during
11that period may be discharged at the will of the Director.
12However, the Director may in his or her sole discretion extend
13the probationary period of an officer up to an additional 6
14months when to do so is deemed in the best interest of the
15Department.
16    (b) Notwithstanding the other provisions of this Act, after
17July 1, 1977 and before July 1, 1980, the Director of State
18Police may appoint and promote not more than 20 persons having
19special qualifications as special agents as he or she deems
20necessary to carry out the Department's objectives. Any such
21appointment or promotion shall be ratified by the Board.
22    (c) During the 90 days following the effective date of this
23amendatory Act of 1995, the Director of State Police may
24appoint up to 25 persons as State Police officers. These
25appointments shall be made in accordance with the requirements
26of this subsection (c) and any additional criteria that may be

1established by the Director, but are not subject to any other
2requirements of this Act. The Director may specify the initial
3rank for each person appointed under this subsection.
4    All appointments under this subsection (c) shall be made
5from personnel certified by the Board. A person certified by
6the Board and appointed by the Director under this subsection
7must have been employed by the Illinois Commerce Commission on
8November 30, 1994 in a job title subject to the Personnel Code
9and in a position for which the person was eligible to earn
10"eligible creditable service" as a "noncovered employee", as
11those terms are defined in Article 14 of the Illinois Pension
12Code.
13    Persons appointed under this subsection (c) shall
14thereafter be subject to the same requirements and procedures
15as other State police officers. A person appointed under this
16subsection must serve a probationary period of 12 months from
17the date of appointment, during which he or she may be
18discharged at the will of the Director.
19    This subsection (c) does not affect or limit the Director's
20authority to appoint other State Police officers under
21subsection (a) of this Section.
