SYNOPSIS AS INTRODUCED:
 
620 ILCS 5/42.1 new

    Amends the Illinois Aeronautics Act. Defines "unmanned aircraft systems". Provides that regulation of unmanned aircraft systems is an exclusive power and function of the State. Restricts home rule power. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Aeronautics Act is amended by
5adding Section 42.1 as follows:
 
6    (620 ILCS 5/42.1 new)
7    Sec. 42.1. Regulation of unmanned aircraft systems.
8    (a) As used in this Section, "unmanned aircraft systems"
9means a powered, aerial vehicle that:
10        (1) does not carry a human operator and is operated
11    without the possibility of direct human intervention from
12    within or on the aircraft;
13        (2) uses aerodynamic forces to provide vehicle lift;
14        (3) can fly autonomously or be piloted remotely; and
15        (4) can be expendable or recoverable.
16    "Unmanned aircraft system" does not include a satellite.
17    (b) The regulation of unmanned aircraft systems is an
18exclusive power and function of the State. A home rule unit may
19not regulate unmanned aircraft systems. This Section is a
20denial and limitation of home rule powers and functions under
21subsection (h) of Section 6 of Article VII of the Illinois
22Constitution.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
