SYNOPSIS AS INTRODUCED:
 
70 ILCS 1005/11.5 new

    Amends the Mosquito Abatement District Act. Provides that upon a majority vote of the board of trustees of a mosquito abatement district in favor of a proposition to annex or consolidate with another mosquito abatement district, a municipality, or a county, and if the governing authorities of the governmental unit assuming the functions of the former district agree by resolution to accept the functions (and jurisdiction over the territory, if applicable) of the consolidated or annexed mosquito abatement district, then the mosquito abatement district shall cease. Provides that on the effective date of the annexation or consolidation, all of the rights, powers, duties, assets, liabilities, indebtedness, obligations, bonding authority, taxing authority, and responsibilities of the district vests in and is assumed by the governmental unit assuming the former district's functions. Provides for the rights of the employees of the former district once the former district is consolidated into the other governmental unit.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mosquito Abatement District Act is amended
5by adding Section 11.5 as follows:
 
6    (70 ILCS 1005/11.5 new)
7    Sec. 11.5. Cessation of district organization.
8Notwithstanding any other provision of law, if a majority vote
9of the board of trustees of a mosquito abatement district is in
10favor of a proposition to annex the district to another
11mosquito abatement district whose boundaries are contiguous,
12consolidate the district into a municipality that the district
13is coterminous or substantially coterminous, or consolidate
14the district into the county in which the district sits, and if
15the governing authorities of the governmental unit assuming the
16functions of the former district agree by resolution to accept
17the functions (and jurisdiction over the territory, if
18applicable) of the consolidated or annexed district, then the
19district shall cease. On the effective date of the annexation
20or consolidation, all the rights, powers, duties, assets,
21property, liabilities, indebtedness, obligations, bonding
22authority, taxing authority, and responsibilities of the
23district shall vest in and be assumed by the governmental unit

1assuming the functions of the former district.
2    The employees of the former district shall be transferred
3to the governmental unit assuming the functions of the former
4district. The governmental unit assuming the functions of the
5former district shall exercise the rights and responsibilities
6of the former district with respect to those employees. The
7status and rights of the employees of the former district under
8any applicable contracts or collective bargaining agreements,
9historical representation rights under the Illinois Public
10Labor Relations Act, or under any pension, retirement, or
11annuity plan shall not be affected by this amendatory Act of
12the 100th General Assembly.
