SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/5-117

    Amends the Public Utilities Act. Requires all local exchange telecommunications carriers with at least 35,000 subscriber access lines, any person or entity providing cable service or video service, and any wireless telephone carrier and internet service provider serving Illinois residents to submit an annual report concerning procurement goals and actual spending for female-owned, minority-owned, veteran-owned, and small business enterprises. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by changing
5Section 5-117 as follows:
 
6    (220 ILCS 5/5-117)

8    Sec. 5-117. Supplier diversity goals.
9    (a) The public policy of this State is to collaboratively
10work with companies that serve Illinois residents to improve
11their supplier diversity in a non-antagonistic manner.
12    (b) The Commission shall require all gas, electric, and
13water companies with at least 100,000 customers under its
14authority to submit an annual report by April 15, 2015 and
15every April 15 thereafter, in a searchable Adobe PDF format, on
16all procurement goals and actual spending for female-owned,
17minority-owned, veteran-owned, and small business enterprises
18in the previous calendar year. These goals shall be expressed
19as a percentage of the total work performed by the entity
20submitting the report, and the actual spending for all
21female-owned, minority-owned, veteran-owned, and small
22business enterprises shall also be expressed as a percentage of
23the total work performed by the entity submitting the report.

1The provisions of this subsection (b) regarding the submission
2of an annual report on procurement goals and actual spending
3shall also apply to all local exchange telecommunications
4carriers with at least 35,000 subscriber access lines, any
5person or entity providing cable service or video service, as
6defined in Section 21-201 of this Act, and any wireless
7telephone carrier and internet service provider serving
8Illinois residents.
9    (c) Each participating company in its annual report shall
10include the following information:
11        (1) an explanation of the plan for the next year to
12    increase participation;
13        (2) an explanation of the plan to increase the goals;
14        (3) the areas of procurement each company shall be
15    actively seeking more participation in in the next year;
16        (4) an outline of the plan to alert and encourage
17    potential vendors in that area to seek business from the
18    company;
19        (5) an explanation of the challenges faced in finding
20    quality vendors and offer any suggestions for what the
21    Commission could do to be helpful to identify those
22    vendors;
23        (6) a list of the certifications the company
24    recognizes;
25        (7) the point of contact for any potential vendor who
26    wishes to do business with the company and explain the

1    process for a vendor to enroll with the company as a
2    minority-owned, women-owned, or veteran-owned company; and
3        (8) any particular success stories to encourage other
4    companies to emulate best practices.
5    (d) Each annual report shall include as much State-specific
6data as possible. If the submitting entity does not submit
7State-specific data, then the company shall include any
8national data it does have and explain why it could not submit
9State-specific data and how it intends to do so in future
10reports, if possible.
11    (e) Each annual report shall include the rules,
12regulations, and definitions used for the procurement goals in
13the company's annual report.
14    (f) The Commission and all participating entities shall
15hold an annual workshop open to the public in 2015 and every
16year thereafter on the state of supplier diversity to
17collaboratively seek solutions to structural impediments to
18achieving stated goals, including testimony from each
19participating entity as well as subject matter experts and
20advocates. The Commission shall publish a database on its
21website of the point of contact for each participating entity
22for supplier diversity, along with a list of certifications
23each company recognizes from the information submitted in each
24annual report. The Commission shall publish each annual report
25on its website and shall maintain each annual report for at
26least 5 years.

14female-owned, minority-owned, veteran-owned, and small
15business enterprises in the previous calendar year. These goals
16shall be expressed as a percentage of the total work performed
17by the entity submitting the report, and the actual spending
18for all female-owned, minority-owned, veteran-owned, and small
19business enterprises shall also be expressed as a percentage of
20the total work performed by the entity submitting the report.

23    Section 95. No acceleration or delay. Where this Act makes
24changes in a statute that is represented in this Act by text

2not accelerate or delay the taking effect of (i) the changes
3made by this Act or (ii) provisions derived from any other

5    Section 99. Effective date. This Act takes effect upon
6becoming law.
