SYNOPSIS AS INTRODUCED:

    Amends the Southern Illinois University Management Act. Provides that on the effective date of the amendatory Act, the terms of office of the members of the Board of Trustees of Southern Illinois University shall terminate and the Board shall be reconstituted. With regard to the 7 members of the Board appointed by the Governor, by and with the advice and consent of the Senate, specifies that after the effective date of the amendatory Act, the 7 members shall be appointed as follows: 3 appointees shall hold an undergraduate or graduate degree from the Southern Illinois University at Edwardsville campus, 3 appointees shall hold an undergraduate or graduate degree from the Southern Illinois University at Carbondale campus, and one appointee must not have attended Southern Illinois University at all. Changes the voting student member to an additional nonvoting student member, and deletes provisions concerning the designation of a voting student member and a nonvoting student member; makes related changes. Sets forth provisions concerning the expiration of the terms of the 7 initial members appointed by the Governor, by and with the advice and consent of the Senate, pursuant to the amendatory Act.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Southern Illinois University Management Act
5is amended by changing Sections 2, 4, and 5 as follows:
 
6    (110 ILCS 520/2)  (from Ch. 144, par. 652)
7    Sec. 2. On the effective date of this amendatory Act of the
8100th General Assembly, the terms of office of the members of
9the Board shall terminate and the Board shall be reconstituted.
10After the effective date of this amendatory Act of the 100th
11General Assembly, the The Board shall consist of 7 members
12appointed by the Governor, by and with the advice and consent
13of the Senate, as follows: 3 appointees shall hold an
14undergraduate or graduate degree from the Southern Illinois
15University at Edwardsville campus, 3 appointees shall hold an
16undergraduate or graduate degree from the Southern Illinois
17University at Carbondale campus, and one appointee must not
18have attended Southern Illinois University at all. The Board
19shall also consist of the Superintendent of Public Instruction,
20or his chief assistant for liaison with higher education when
21designated to serve in his place, ex-officio, and 2 nonvoting
22one voting student members. member designated by the Governor
23from one campus of the University and one nonvoting student

1member from the campus of the University not represented by the
2voting student member. The Governor shall designate one of the
3student members serving on the Board to serve as the voting
4student member. Each student member shall be selected chosen by
5the respective campuses of Southern Illinois University at
6Carbondale and Edwardsville. The method of selecting choosing
7these student members shall be by campus-wide student election,
8and any student designated by the Governor to be a voting
9student member shall be one of the students chosen by this
10method. The student members shall serve terms of one year
11beginning on July 1 of each year, except that the student
12members initially selected shall serve a term beginning on the
13date of such selection and expiring on the next succeeding June
1430. To be eligible for selection as a student member and to be
15eligible to remain as a voting or nonvoting student member of
16the Board, a student member must be a resident of this State,
17must have and maintain a grade point average that is equivalent
18to at least 2.5 on a 4.0 scale, and must be a full time student
19enrolled at all times during his or her term of office except
20for that part of the term which follows the completion of the
21last full regular semester of an academic year and precedes the
22first full regular semester of the succeeding academic year at
23the university (sometimes commonly referred to as the summer
24session or summer school). If a voting or nonvoting student
25member serving on the Board fails to continue to meet or
26maintain the residency, minimum grade point average, or

1enrollment requirement established by this Section, his or her
2membership on the Board shall be deemed to have terminated by
3operation of law. No more than 4 of the members appointed by
4the Governor shall be affiliated with the same political party.
5Each member appointed by the Governor must be a resident of
6this State. A failure to meet or maintain this residency
7requirement constitutes a resignation from and creates a
8vacancy in the Board. The terms of the members appointed by the
9Governor, by and with the advice and consent of the Senate,
10pursuant to this amendatory Act of the 100th General Assembly
11shall expire as follows: the terms of one member each from the
12Southern Illinois University at Edwardsville campus and the
13Southern Illinois University at Carbondale campus shall expire
14on the third Monday in January 2021; the terms of one member
15each from the Southern Illinois University at Edwardsville
16campus and the Southern Illinois University at Carbondale
17campus shall expire on the third Monday in January 2022; and
18the terms of the remaining 3 members shall expire on the third
19Monday in January 2025. Upon the expiration of the terms of
20members appointed by the Governor, their respective successors
21shall be appointed for terms of 6 years from the third Monday
22in January of each odd-numbered year and until their respective
23successors are appointed for like terms. If the Senate is not
24in session appointments shall be made as in the case of
25vacancies.

3    Sec. 4. Members of the Board shall serve without
4compensation but shall be entitled to reasonable amounts for
5expenses necessarily incurred in the performance of their
6duties. Such expenses incurred by any non-voting student member
7may, at the discretion of the Chairman of the Board, be
8provided for by advance payment to such member, who shall
9account therefor to the Board immediately after each meeting.
10    No member of the Board shall hold or be employed in or
11appointed to any office or place under the authority of the
12Board, nor shall any member of the Board be directly or
13indirectly interested in any contract made by the Board, nor
14shall he be an employee of the State Government. This section
15does not prohibit the student members of the Board from
16maintaining normal and official status as enrolled students or
17normal student employment at Southern Illinois University.

20    Sec. 5. Members of the Board shall elect annually by secret
21ballot from their own number a chairman who shall preside over
22meetings of the Board and a secretary.
23    Meetings of the Board shall be held at least once each
24quarter on a campus of Southern Illinois University. At all

1regular meetings of the Board, a majority of its voting members
2shall constitute a quorum. The student members shall have all
3of the privileges of membership, including the right to make
4and second motions and to attend executive sessions, other than
5the right to vote, except that the student member designated by
6the Governor as the voting student member shall have the right
7to vote on all Board matters except those involving faculty
8tenure, faculty promotion or any issue on which the student
9member has a direct conflict of interest. For the purposes of
10this Section, a student member shall not be deemed to have a
11direct conflict of interest in and may vote on any item
12involving the employment or compensation of the Chancellor at
13any campus or the President of the University or the election
14of officers. A student member who is not entitled to vote on a
15measure at a meeting of the Board or any of its committees
16shall not be considered a member for the purpose of determining
17whether a quorum is present at the time that measure is voted
18upon. No action of the Board shall be invalidated by reason of
19any vacancies on the Board, or by reason of any failure to
20select a student member.
21    Special meetings of the Board may be called by the chairman
22of the Board or by any 3 members of the Board.
23    At each regular and special meeting that is open to the
24public, members of the public and employees of the University
25shall be afforded time, subject to reasonable constraints, to
26make comments to or ask questions of the Board.
