SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/16-163  from Ch. 108 1/2, par. 16-163
40 ILCS 5/16-164  from Ch. 108 1/2, par. 16-164

    Amends the Downstate Teacher Article of the Illinois Pension Code. Reduces the composition of the Board to 11 members (instead of 13 members) by removing 2 of the members of the Board appointed by the Governor. Provides that the 2 members whose office is being abolished pursuant to the amendatory Act shall be from the members whose terms of office expire on July 14, 2018. Effective immediately.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by changing
5Sections 16-163 and 16-164 as follows:
 
6    (40 ILCS 5/16-163)  (from Ch. 108 1/2, par. 16-163)
7    Sec. 16-163. Board created. A board of 11 13 members
8constitutes the board of trustees authorized to carry out the
9provisions of this Article and is responsible for the general
10administration of the System. The board shall be known as the
11Board of Trustees of the Teachers' Retirement System of the
12State of Illinois. The board shall be composed of the
13Superintendent of Education, ex officio, who shall be the
14president of the board; 4 6 persons, not members of the System,
15to be appointed by the Governor, who shall hold no elected
16State office; 4 persons who, at the time of their election, are
17teachers as defined in Section 16-106, elected by the
18contributing members; and 2 annuitant members elected by the
19annuitants of the System, as provided in Section 16-165.

22    Sec. 16-164. Board - appointed members - vacancies. Terms

1of office for the appointed members shall begin on July 15 of
2an even-numbered year, except that the terms of office for
3members appointed pursuant to this amendatory Act of the 96th
4General Assembly shall begin upon being confirmed by the
5Senate. The Governor shall appoint 2 3 members as trustees with
6the advice and consent of the Senate in each even-numbered year
7who shall hold office for a term of 4 years, except that, of
8the members appointed pursuant to this amendatory Act of the
996th General Assembly, 3 members shall be appointed for a term
10ending July 14, 2012 and 3 members shall be appointed for a
11term ending July 14, 2014. Each such appointee shall reside in
12and be a taxpayer in the territory covered by this system,
13shall be interested in public school welfare, and experienced
14and competent in financial and business management. A vacancy
15in the term of an appointed trustee shall be filled for the
16unexpired term by appointment of the Governor.
17    The 2 members whose office is abolished pursuant to this
18amendatory Act of the 100th General Assembly shall be from the
19members whose terms of office expire on July 14, 2018.
20    Notwithstanding any provision of this Section to the
21contrary, the term of office of each member of the Board
22appointed by the Governor who is sitting on the Board on the
23effective date of this amendatory Act of the 96th General
24Assembly is terminated on that effective date. A trustee
25sitting on the Board on the effective date of this amendatory
26Act of the 96th General Assembly may not hold over in office

1for more than 60 days after the effective date of this
2amendatory Act of the 96th General Assembly. Nothing in this
3Section shall prevent the Governor from making a temporary
4appointment or nominating a trustee holding office on the day
5before the effective date of this amendatory Act of the 96th
6General Assembly.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
