SYNOPSIS AS INTRODUCED:

305 ILCS 5/5-5.4j new

    Amends the Mental Health and Developmental Disabilities Administrative Act and the Illinois Public Aid Code. Provides that the Department of Human Services shall progressively increase rates and reimbursements so that by July 1, 2018 direct support persons earn a base wage of not less than $5.25 per hour above the highest of the federal, State, county, or municipal minimum wages, and so that other front-line personnel earn a commensurate wage, and by July 1, 2020 direct support persons earn a base wage of not less than $6.75 per hour above the highest of the federal, State, county, or municipal minimum wages. Effective immediately.

1    AN ACT concerning wages for front-line personnel.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mental Health and Developmental
5Disabilities Administrative Act is amended by adding Section
655.5 as follows:
 
7    (20 ILCS 1705/55.5 new)
8    Sec. 55.5. Increased wages for front-line personnel. As
9used in this Section, "front-line personnel" means direct
10support persons, aides, front-line supervisors, qualified
11intellectual disabilities professionals, nurses, and
12non-administrative support staff working in service settings
13outlined in this Section. The Department shall progressively
14increase rates and reimbursements so that by July 1, 2018
15direct support persons earn a base wage of not less than $5.25
16per hour above the highest of the federal, State, county, or
17municipal minimum wages, and so that other front-line personnel
18earn a commensurate wage, and by July 1, 2020 direct support
19persons earn a base wage of not less than $6.75 per hour above
20the highest of the federal, State, county, or municipal minimum
21wages, and so that other front-line personnel earn a
22commensurate wage.
23    The Department shall establish reimbursement rates which

1build toward livable wages for front-line personnel in
2residential and day programs and service coordination agencies
3serving persons with intellectual and developmental
4disabilities under Section 54 of this Act, including, but not
5limited to, intermediate care for the developmentally disabled
6facilities, medically complex for the developmentally disabled
7facilities, community-integrated living arrangements,
8community day services, employment, and other residential and
9day programs for persons with intellectual and developmental
10disabilities supported by State funds or funding under Title
11XIX of the federal Social Security Act.
 
12    Section 10. The Illinois Public Aid Code is amended by
13adding Section 5-5.4j as follows:
 
14    (305 ILCS 5/5-5.4j new)
15    Sec. 5-5.4j. Increased wages for front-line personnel. As
16used in this Section, "front-line personnel" means direct
17support persons, aides, front-line supervisors, qualified
18intellectual disabilities professionals, nurses, and
19non-administrative support staff working in service settings
20outlined in this Section.
21    Under Section 55.5 of the Mental Health and Developmental
22Disabilities Administrative Act, the payment rate for all
23facilities licensed by the Department of Public Health under
24the ID/DD Community Care Act as intermediate care for the

1developmentally disabled facilities and under the MC/DD Act as
2medically complex for the developmentally disabled facilities
3shall be increased to fund rates and reimbursements so that by
4July 1, 2018 direct support persons earn a base wage of not
5less than $5.25 per hour above the highest of the federal,
6State, county, or municipal minimum wages, and so that other
7front-line personnel earn a commensurate wage, and by July 1,
82020 direct support persons earn a base wage of not less than
9$6.75 per hour above the highest of the federal, State, county,
10or municipal minimum wages and so that other front-line
11personnel earn a commensurate wage.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
