AMENDMENT TO HOUSE BILL 4747 




2    AMENDMENT NO. ______. Amend House Bill 4747 on page 4, by 
3inserting immediately below line 8 the following:


 
4    ""Nonroad engine" means an internal combustion engine, 
5including the fuel system, that is not (i) used in a motor 
6vehicle or a vehicle used solely for competition or (ii) 
7subject to the standards of performance for new stationary 
8sources or the emission standards for new motor vehicles or new 
9motor vehicle engines promulgated under the Clean Air Act, 42 
10U.S.C. 7411 and 7521.

11    "Nonroad equipment" means equipment that is powered by a 
12nonroad engine and that is not a motor vehicle, a vehicle used 
13solely for competition, or a nonroad vehicle.
14    "Nonroad vehicle" means a vehicle that is powered by a 
15nonroad engine and that is not a motor vehicle or a vehicle 
16used solely for competition.


17    "Nonroad engine, nonroad equipment, or nonroad vehicle

1dealer" means any person who is engaged in the sale or the 
2distribution of new nonroad engines, new nonroad equipment, or 
3new nonroad vehicles to the ultimate purchaser.


4    "Nonroad engine, nonroad equipment, or nonroad vehicle 
5manufacturer" means any person engaged in the manufacturing or 
6assembling of new nonroad engines, new nonroad equipment, or 
7new nonroad vehicles, or importing such engines, equipment, or 
8vehicles for resale, or who acts for and is under the control 
9of any such person in connection with the distribution of new 
10nonroad engines, new nonroad equipment, or new nonroad 
11vehicles, but does not include any dealer with respect to new 
12nonroad engines, new nonroad equipment, or new nonroad vehicles 
13received by the dealer in commerce."; and

 
14on page 4, by inserting immediately below line 21 the 
15following:


16    ""Stationary engine" means an internal combustion engine 
17that is not used in a motor vehicle, a vehicle used solely for 
18competition, a nonroad vehicle, or nonroad equipment.
19    "Stationary equipment" means equipment that is powered by a 
20stationary engine and that is not a motor vehicle, a vehicle 
21used solely for competition, a nonroad vehicle, or nonroad 
22equipment.
23    "Stationary engine or stationary equipment dealer" means 
24any person who is engaged in the sale or the distribution of 
25new stationary engines or new stationary equipment to the

1ultimate purchaser.
2     "Stationary engine or stationary equipment manufacturer" 
3means any person engaged in the manufacturing or assembling of 
4new stationary engines or new stationary equipment, or 
5importing such engines or equipment for resale, or who acts for 
6and is under the control of any such person in connection with 
7the distribution of new stationary engines or new stationary 
8equipment, but does not include any dealer with respect to new 
9stationary engines or new stationary equipment received by the 
10dealer in commerce."; and

 
11on page 11, line 2, by inserting after the period the 
12following:
13"Nothing in this Act applies to (1) nonroad engine, nonroad 
14equipment, or nonroad vehicle manufacturers, any product or 
15service of a nonroad engine, nonroad equipment, or nonroad 
16vehicle manufacturer, or nonroad engine, nonroad equipment, or 
17nonroad vehicle dealers; or (2) stationary engine or stationary 
18equipment manufacturers, any product or service of a stationary 
19engine or stationary equipment manufacturer, or stationary 
20engine or stationary equipment dealers.".
