AMENDMENT TO HOUSE BILL 4654

2    AMENDMENT NO. ______. Amend House Bill 4654, by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 11-710 and 12-604.1 and by adding Sections
61-159.4 and 11-1432 as follows:
 
7    (625 ILCS 5/1-159.4 new)
8    Sec. 1-159.4. Platoon. A group of individual motor vehicles
9traveling in a unified manner utilizing vehicle-to-vehicle
10communications technology at following distances that are
11closer than distances provided in subsection (a) of Section
1211-710 for vehicles traveling without vehicle-to-vehicle
13communications technology.

15    Sec. 11-710. Following too closely. (a) The driver of a

1motor vehicle shall not follow another vehicle more closely
2than is reasonable and prudent, having due regard for the speed
3of such vehicles and the traffic upon and the condition of the
4highway.
5    (b) The driver of any truck or motor vehicle drawing
6another vehicle when traveling upon a roadway outside of a
7business or residence district and which is following another
8truck or motor vehicle drawing another vehicle shall, whenever
9conditions permit, leave sufficient space so that an overtaking
10vehicle may enter and occupy such space without danger, except
11that this shall not prevent a truck or motor vehicle drawing
12another vehicle from overtaking and passing any vehicle or
13combination of vehicles.
14    (c) Motor vehicles being driven upon any roadway outside of
15a business or residence district in a caravan or motorcade
16whether or not towing other vehicles shall be so operated as to
17allow sufficient space between each such vehicle or combination
18of vehicles so as to enable any other vehicle to enter and
19occupy such space without danger. This provision shall not
20apply to funeral processions.
21    (d) This Section does not apply to a driver of a non-lead
22motor vehicle operating in a platoon.

25    Sec. 11-1432. Plan for general platoon operations.

1    (a) Before the operation of a platoon upon the streets or
2highways of this State, a person shall file a plan for general
3platoon operations with the Department of State Police. The
4Department of State Police shall approve or reject the plan. If
5the plan is rejected, the Department of State Police shall
6provide the reason for the rejection and provide guidance on
7how to resubmit the plan to meet the Department of State
8Police's requirements. The Department of State Police may adopt
9rules to implement this Section.
10    (b) The plan for general platoon operations required under
11this Section shall include, but not be limited to, platoon
12routes, platoon technology features and functionality, and
13platoon driver training.
14    (c) An appropriately endorsed driver, who holds a valid
15commercial driver's license, shall be present behind the wheel
16of each motor vehicle in a platoon.
17    (d) A platoon shall consist of no more than 2 motor
18vehicles.

20    Sec. 12-604.1. Video devices.
21    (a) A person may not operate a motor vehicle if a
22television receiver, a video monitor, a television or video
23screen, or any other similar means of visually displaying a
24television broadcast or video signal that produces
25entertainment or business applications is operating and is

1located in the motor vehicle at any point forward of the back
2of the driver's seat, or is operating and visible to the driver
3while driving the motor vehicle.
4    (a-5) A person commits aggravated use of a video device
5when he or she violates subsection (a) and in committing the
6violation he or she was involved in a motor vehicle accident
7that results in great bodily harm, permanent disability,
8disfigurement, or death to another and the violation was a
9proximate cause of the injury or death.
10    (b) This Section does not apply to the following equipment,
11whether or not permanently installed in a vehicle:
12        (1) a vehicle information display;
13        (2) a global positioning display;
14        (3) a mapping or navigation display;
15        (4) a visual display used to enhance or supplement the
16    driver's view forward, behind, or to the sides of a motor
17    vehicle for the purpose of maneuvering the vehicle;
18        (5) television-type receiving equipment used
19    exclusively for safety or traffic engineering studies; or
20        (6) a television receiver, video monitor, television
21    or video screen, or any other similar means of visually
22    displaying a television broadcast or video signal, if that
23    equipment has an interlock device that, when the motor
24    vehicle is driven, disables the equipment for all uses
25    except as a visual display as described in paragraphs (1)
26    through (5) of this subsection (b).

1    (c) This Section does not apply to a mobile, digital
2terminal installed in an authorized emergency vehicle, a motor
3vehicle providing emergency road service or roadside
4assistance, or to motor vehicles utilized for public
5transportation.
6    (d) This Section does not apply to a television receiver,
7video monitor, television or video screen, or any other similar
8means of visually displaying a television broadcast or video
9signal if: (i) the equipment is permanently installed in the
10motor vehicle; and (ii) the moving entertainment images that
11the equipment displays are not visible to the driver while the
12motor vehicle is in motion.
13    (d-5) This Section does not apply to a video event
14recorder, as defined in Section 1-218.10 of this Code,
15installed in a contract carrier vehicle.
16    (d-7) This Section does not apply to a video device used in
17a vehicle traveling in a platoon that: (i) allows the lead
18driver to see his or her vehicle from a non-lead driver's
19perspective and a non-lead driver to view the road from the
20lead driver's perspective; or (ii) that displays platoon
21information.
22    (e) Except as provided in subsection (f) of this Section, a
23person convicted of violating this Section is guilty of a petty
24offense and shall be fined not more than $100 for a first
25offense, not more than $200 for a second offense within one
26year of a previous conviction, and not more than $250 for a

1third or subsequent offense within one year of 2 previous
2convictions.
3    (f) A person convicted of violating subsection (a-5)
4commits a Class A misdemeanor if the violation resulted in
5great bodily harm, permanent disability, or disfigurement to
6another. A person convicted of violating subsection (a-5)
7commits a Class 4 felony if the violation resulted in the death
8of another person.
