SYNOPSIS AS INTRODUCED:
 
70 ILCS 2005/11.5 new

    Amends the Rescue Squad Districts Act. Provides that a rescue squad district may, by ordinance, submit a referendum to the voters for a special annual tax for the purpose of providing funds to pay the costs of emergency and rescue crews and equipment. Provides the special annual tax rate may not exceed 0.10% of the value of all taxable property within the district. Includes the language to be used in the referendum. Provides that after approval of the referendum by the voters of the district, the board of trustees of the rescue squad district shall, by resolution, set or amend the rate of the special tax to be levied by the district at a rate not to exceed 0.10% of the value of all taxable property in the district as equalized or assessed by the Department of Revenue. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Rescue Squad Districts Act is amended by
5adding Section 11.5 as follows:
 
6    (70 ILCS 2005/11.5 new)
7    Sec. 11.5. Special annual tax.
8    (a) In addition to any other tax authorized by law, a
9rescue squad district may, subject to the requirements of this
10Section, by ordinance and referendum, levy a special annual tax
11at a rate not exceeding 0.10% of the value, as equalized or
12assessed by the Department of Revenue, on all taxable property
13within the district, for the purpose of obtaining funds to pay
14for the costs of emergency and rescue crews and equipment. The
15board of trustees shall determine and certify the amount to be
16levied and shall return the same to the county clerk. The
17limitation upon the tax rate may be increased or decreased
18under the referendum provisions of the General Revenue Law of
19Illinois.
20    In case the district is located in more than one county,
21the board of trustees shall determine and certify the amount to
22be levied upon the taxable property lying in each county and
23return the same to the respective county clerks of the counties

1in which the amount is to be levied. In order to determine the
2amount to be levied upon the taxable property of that part of
3the district lying in each county, the board shall ascertain
4from the county clerk of the respective counties in which the
5district lies the last ascertained equalized value of the
6taxable property of the district lying in their respective
7counties, then shall ascertain the rate per cent required and
8shall, accordingly, apportion the whole amount to be raised
9between the several parts of the district so lying in the
10different counties. The tax provided for in this Section shall
11be levied at the same time and in the same manner as nearly as
12practicable as taxes are now levied for municipal purposes
13under the laws of this State.
14    The tax under this Section, when collected, shall be paid
15over to the treasurer of the board of trustees, who is
16authorized to receive and receipt for the same.
17    (b) Whenever a rescue squad district desires to levy a
18special tax under this Section, it shall certify the question
19to the proper election officials, who shall submit that
20question at an election to the voters of the district in
21accordance with the general election law. The result of the
22referendum shall be entered upon the records of the district.
23If a majority of the votes on the referendum are in favor of
24the referendum, the rescue squad district may then levy a
25special tax under this Section at a rate not to exceed 0.10% of
26the value of all taxable property within the district as

1equalized or assessed by the Department of Revenue. The
2referendum shall be in substantially the following form:

14    (c) After approval of the referendum by the voters of the
15district, the board of trustees of the rescue squad district
16shall, by resolution, set or amend the rate of the special tax
17to be levied by the district at a rate not to exceed 0.10% of
18the value of all taxable property within the district as
19equalized or assessed by the Department of Revenue.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
