AMENDMENT TO HOUSE BILL 3773

2    AMENDMENT NO. ______. Amend House Bill 3773 on page 1, by
3replacing line 5 with the following:
4"Sections 3 and 4 as follows:"; and
 
5on page 5, immediately below line 21, by inserting the
6following:
 
7    "(425 ILCS 60/4)  (from Ch. 127 1/2, par. 804)
8    Sec. 4. (a) Except as provided in subsection (c), willful
9Willful failure to install or maintain in operating condition
10any smoke detector required by this Act shall be a Class B
11misdemeanor.
12    (b) Except as provided in subsection (c), tampering
13Tampering with, removing, destroying, disconnecting or
14removing the batteries from any installed smoke detector,
15except in the course of inspection, maintenance or replacement
16of the detector, shall be a Class A misdemeanor in the case of

1a first conviction, and a Class 4 felony in the case of a
2second or subsequent conviction.
3    (c) A party in violation of the battery requirements of
4subsection (e) of Section 3 of this Act shall be provided with
590 day's warning with which to rectify that violation. If that
6party fails to rectify the violation within that 90 day period,
7he or she shall be assessed a fine of $100, and shall be fined
8$100 every 30 days thereafter until either the violation is
9rectified or the cumulative amount of fines assessed reaches
10$1,500. The provisions of subsection (a) and (b) of this
11Section shall apply only after the penalty provided under this
12subsection (c) has been exhausted to the extent that a
13violating party has reached the $1,500 cumulative fine
14threshold and has failed to rectify the violation.
