AMENDMENT TO HOUSE BILL 2938

2    AMENDMENT NO. ______. Amend House Bill 2938 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Legislative findings. The General Assembly
5finds that the maximum speed limits for motor vehicles
6prescribed in a provision concerning general speed
7restrictions in the Illinois Vehicle Code are presumed to be
8reasonable and safe maximum speed limits for all highways under
9the jurisdiction of the Illinois State Toll Highway Authority.
 
10    Section 5. The Illinois Vehicle Code is amended by changing
11Section 11-603 as follows:

13    Sec. 11-603. Alteration of limits by Toll Highway
14Authority.
15    (a) Whenever the Illinois State Toll Highway Authority

1determines, upon the basis of an engineering and traffic
2investigation concerning a toll highway under its
3jurisdiction, that a maximum speed limit prescribed in Section
411-601 of this Chapter is greater or less than is reasonable or
5safe with respect to conditions found to exist at any place or
6along any part or zone of such highway, the Authority shall
7determine and declare by regulation a reasonable and safe
8absolute maximum speed limit at such place or along such part
9or zone, and the speed limit shall conform with the maximum
10speed limit restrictions provided for in Section 11-601 of this
11Code. A limit so determined and declared becomes effective, and
12suspends the application of the limit prescribed in Section
1311-601 of this Chapter, when (a) the Department concurs in
14writing with the Authority's regulation, and (b) appropriate
15signs giving notice of the limit are erected at such place or
16along such part or zone of the highway, and (c) for a decrease
17in a speed limit, the General Assembly approves the Authority's
18regulation. The Authority shall not issue regulations to change
19the maximum speed limit for vehicles of the second division
20weighing more than 8,000 pounds that is more than 10 miles per
21hour less than the maximum speed limit of that highway.
22Electronic speed-detecting devices shall not be used within 500
23feet beyond any such sign in the direction of travel; if so
24used in violation hereof, evidence obtained thereby shall be
25inadmissible in any prosecution for speeding.
26    (b) Beginning 12 months after the effective date of this

1amendatory Act of the 100th General Assembly, and except for
2vehicles of the second division weighing more than 8,000
3pounds, the effective absolute maximum speed limit on any part
4of a highway under the Authority's jurisdiction shall be: (1)
5except for Interstate Route 294 and the portion of Interstate
6Route 94 that is between Interstate Route 294 and U.S. Route
741, 70 miles per hour or the maximum speed limit under Section
811-601 of this Code, whichever is less; and (2) 60 miles per
9hour or the maximum speed limit under Section 11-601 of this
10Code, whichever is less, on Interstate Route 294 and the
11portion of Interstate Route 94 that is between Interstate Route
12294 and U.S. Route 41. If Interstate Route 294 undergoes
13construction that results in an increase in the maximum design
14speed limit, the effective absolute maximum speed limit shall
15be the maximum design speed limit or the maximum speed limit
16under Section 11-601 of this Code, whichever is less, within 12
17months of the design speed limit change. The maximum speed
18limits under this subsection (b) may be altered under
19subsection (a) of this Section. The Authority shall issue
20regulations to implement this subsection (b).
