1 | | determines, upon the basis of an
engineering and traffic |
2 | | investigation concerning a toll highway under its
|
3 | | jurisdiction, that a maximum speed limit prescribed in Section |
4 | | 11-601 of
this Chapter is greater or less than is reasonable or |
5 | | safe with respect to
conditions found to exist at any place or |
6 | | along any part or zone of such
highway, the Authority shall |
7 | | determine and declare by regulation a
reasonable and safe |
8 | | absolute maximum speed limit at such place or along
such part |
9 | | or zone, and the speed limit shall conform with the maximum |
10 | | speed limit restrictions provided for in Section 11-601 of this |
11 | | Code. A limit so determined
and declared becomes effective, and |
12 | | suspends the application of the limit
prescribed in Section |
13 | | 11-601 of this Chapter, when (a) the Department
concurs in |
14 | | writing with the Authority's regulation, and (b) appropriate
|
15 | | signs giving notice of the limit are erected at such place or |
16 | | along such
part or zone of the highway , and (c) for a decrease |
17 | | in a speed limit, the General Assembly approves the Authority's |
18 | | regulation. The Authority shall not issue regulations to change |
19 | | the maximum speed limit for vehicles of the second division |
20 | | weighing more than 8,000 pounds that is more than 10 miles per |
21 | | hour less than the maximum speed limit of that highway . |
22 | | Electronic speed-detecting devices shall not
be used within 500 |
23 | | feet beyond any such sign in the direction of travel; if
so |
24 | | used in violation hereof, evidence obtained thereby shall be

25 | | inadmissible in any prosecution for speeding.

26 | | (b) Beginning 12 months after the effective date of this |

1 | | amendatory Act of the 100th General Assembly, and except for |
2 | | vehicles of the second division weighing more than 8,000 |
3 | | pounds, the effective absolute maximum speed limit on any part |
4 | | of a highway under the Authority's jurisdiction shall be: (1) |
5 | | except for Interstate Route 294 and the portion of Interstate |
6 | | Route 94 that is between Interstate Route 294 and U.S. Route |
7 | | 41, 70 miles per hour or the maximum speed limit under Section |
8 | | 11-601 of this Code, whichever is less; and (2) 60 miles per |
9 | | hour or the maximum speed limit under Section 11-601 of this |
10 | | Code, whichever is less, on Interstate Route 294 and the |
11 | | portion of Interstate Route 94 that is between Interstate Route |
12 | | 294 and U.S. Route 41. If Interstate Route 294 undergoes |
13 | | construction that results in an increase in the maximum design |
14 | | speed limit, the effective absolute maximum speed limit shall |
15 | | be the maximum design speed limit or the maximum speed limit |
16 | | under Section 11-601 of this Code, whichever is less, within 12 |
17 | | months of the design speed limit change. The maximum speed |
18 | | limits under this subsection (b) may be altered under |
19 | | subsection (a) of this Section. The Authority shall issue |
20 | | regulations to implement this subsection (b). |
