SYNOPSIS AS INTRODUCED:
 
235 ILCS 5/6-34

    Amends the Liquor Control Act of 1934. In a provision that prohibits a person from bringing into this State an alcohol without liquid machine, makes changes to the definition of "alcohol without liquid machine". Provides that "alcohol without liquid machine" does not include certain medical devices or alternative nicotine products.

1    AN ACT concerning liquor.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Liquor Control Act of 1934 is amended by
5changing Section 6-34 as follows:
 
6    (235 ILCS 5/6-34)
7    Sec. 6-34. Alcohol without liquid machines.
8    (a) No person shall bring into this State for use or sale
9any alcohol without liquid machine.
10    (b) For the purposes of this Section, "alcohol without
11liquid machine" means (1) a device designed, manufactured,
12marketed, or used for the purpose of mixing alcoholic liquor or
13powder with oxygen, air, or another gas to produce a mist or
14vapor for inhalation or snorting for non-medicinal purposes; or
15(2) a device designed, manufactured, marketed, or used for the
16purpose of mixing a product with oxygen, air, or another gas to
17produce a mist or vapor for inhalations or snorting that has a
18stimulant, depressant, or hallucinogenic effect on the central
19nervous system for non-medicinal purposes. "Alcohol without
20liquid machine" does not include: (1) such medical devices as
21inhalers, nebulizers, atomizers, or other devices properly
22prescribed by a physician and being used to dispense a
23prescribed medication to the holder of such prescription; or

1(2) an alternative nicotine product, as defined in Section 1.5
2of the Prevention of Tobacco Use by Minors and Sale and
3Distribution of Tobacco Products Act. For the purposes of this
4Section, "alcohol without liquid machine" means a device
5designed or marketed for the purposes of mixing alcohol with
6oxygen or another gas to produce a mist for inhalation for
7recreational purposes.
