1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Emergency Medical Services (EMS) Systems Act
5is amended by adding Section 3.88 as follows:
 
6    (210 ILCS 50/3.88 new)
7    Sec. 3.88. Ambulance assistance vehicle provider upgrades.
8    (a) As used in this Section:
9    "Ambulance assistance vehicle" has the meaning provided
10under 77 Ill. Adm. Code 515.825 and includes, but is not
11limited to, fire apparatus and fire department vehicles.
12    "Ambulance assistance vehicle provider" or "provider"
13means a provider of ambulance assistance vehicles that is
14licensed under this Act and serves a population within the
15State.
16    (b) An ambulance assistance vehicle provider may submit a
17proposal to the EMS Medical Director requesting approval of an
18ambulance assistance vehicle provider in-field service level
19upgrade.
20        (1) An ambulance assistance vehicle provider may be
21    upgraded, as defined by the EMS Medical Director in a
22    policy or procedure, as long as the EMS Medical Director
23    and the Department have approved the proposal, to the

1    highest level of EMT license (advanced life
2    support/paramedic, intermediate life support, or basic
3    life support) or Pre-Hospital RN certification held by any
4    person staffing that provider's ambulance assistance
5    vehicle. The ambulance assistance vehicle provider's
6    proposal for an upgrade must include all of the following:
7            (A) The manner in which the provider will secure
8        and store advanced life support equipment, supplies,
9        and medications.
10            (B) The type of quality assurance the provider will
11        perform.
12            (C) An assurance that the provider will advertise
13        only the level of care that can be provided 24 hours a
14        day.
15            (D) A statement that the provider will have that
16        vehicle inspected by the Department annually.
17        (2) If an ambulance assistance vehicle provider is
18    approved to provide an in-field service level upgrade based
19    on the licensed personnel on the vehicle, all the advanced
20    life support medical supplies, durable medical equipment,
21    and medications must be environmentally controlled,
22    secured, and locked with access by only the personnel who
23    have been authorized by the EMS Medical Director to utilize
24    those supplies.
25        (3) The EMS System shall routinely perform quality
26    assurance, in compliance with the EMS System's quality

1    assurance plan approved by the Department, on in-field
2    service level upgrades authorized under this Section to
3    ensure compliance with the EMS System plan.
4    The EMS Medical Director may define what constitutes an
5in-field service level upgrade through an EMS System policy or
6procedure. An in-field service level upgrade may include, but
7need not be limited to, an upgrade to a licensed ambulance,
8alternate response vehicle, or specialized emergency medical
9services vehicle.
10    (c) If the EMS Medical Director approves a proposal for an
11ambulance assistance vehicle provider's in-field service level
12upgrade under this Section, he or she shall submit the proposal
13to the Department along with a statement of approval signed by
14him or her. Once the Department has approved the proposal, the
15ambulance assistance vehicle provider shall be authorized to
16function at the highest level of EMT license (advanced life
17support/paramedic, intermediate life support, or basic life
18support) or Pre-Hospital RN certification held by any person
19staffing the provider's ambulance assistance vehicle.
20    (d) Nothing in this Section shall allow for the approval of
21a request to downgrade the service level licensure for an
22ambulance assistance vehicle provider.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
