SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-821.2

    Amends the Illinois Vehicle Code. Changes the sunset date to June 30, 2018 (previously June 30, 2017) for a provision providing that the Secretary of State shall not impose a delinquent registration renewal fee for the registration renewal of passenger vehicles of the first division and motor vehicles of the second division weighing not more than 8,000 pounds if a vehicle's registration expires during a period of time in which the Secretary is not sending registration renewal notices to owners of all of those vehicles with registration expiring at the same time as the applicable vehicle. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 3-821.2 as follows:
 
6    (625 ILCS 5/3-821.2)
7    Sec. 3-821.2. Delinquent registration renewal fee.
8    (a) For registration renewal periods beginning on or after
9January 1, 2005, the Secretary of State may impose a delinquent
10registration renewal fee of $20 for the registration renewal of
11all passenger vehicles of the first division and motor vehicles
12of the second division weighing not more than 8,000 pounds if
13the application for registration renewal is received by the
14Secretary more than one month after the expiration of the most
15recent period during which the vehicle was registered. If a
16delinquent registration renewal fee is imposed, the Secretary
17shall not renew the registration of such a vehicle until the
18delinquent registration renewal fee has been paid, in addition
19to any other registration fees owed for the vehicle. Active
20duty military personnel stationed outside of Illinois shall not
21be required to pay the delinquent registration renewal fee. If
22a delinquent registration renewal fee is imposed, the Secretary
23shall adopt rules for the implementation of this Section. All

1fees collected under this Section shall be deposited into the
2General Revenue Fund.
3    (b) Notwithstanding the provisions of subsection (a), the
4Secretary of State shall not impose a delinquent registration
5renewal fee for the registration renewal of passenger vehicles
6of the first division and motor vehicles of the second division
7weighing not more than 8,000 pounds if a vehicle's registration
8expires during a period of time in which the Secretary is not
9sending registration renewal notices to owners of all of those
10vehicles with registration expiring at the same time as the
11applicable vehicle. It shall be an affirmative defense to a
12citation for an expired registration issued by any local,
13county, municipal, or State law enforcement agency within one
14month after the expiration of vehicle registration, that the
15expiration occurred during a period of time in which the
16Secretary was not sending registration renewal notices to
17owners of all passenger vehicles of the first division and
18motor vehicles of the second division weighing not more than
198,000 pounds with registration expiring at the same time as the
20applicable vehicle. A computer print-out of a page from the
21Secretary of State's official website setting forth the
22calendar months in which registration renewal notices were not
23sent to all owners of passenger vehicles of the first division
24and motor vehicles of the second division weighing not more
25than 8,000 pounds shall be admissible as evidence to establish
26the affirmative defense. The computer print-out shall be prima

1facie evidence of the correctness of the information contained
2in it. The changes made by this amendatory Act of the 99th
3General Assembly apply only to vehicle registrations that
4expire on or after the effective date of this amendatory Act of
5the 99th General Assembly.
6    The provisions of this subsection (b), other than this
7sentence, are inoperative on and after June 30, 2018 2017.
