SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/13A-8

    Amends the Alternative Public Schools Article of the School Code. With respect to alternative school programs, provides that each program shall receive funding in the amount of $30,000 plus an amount based on the ratio of the region's or Chicago's last 3 years' average daily attendance of pupils in grades 6 through 12 served by the alternative school program (rather than the best 3 months' average daily attendance in grades pre-kindergarten through 12) to the statewide totals of these amounts. Removes provisions concerning the calculation for determining the best 3 months' average daily attendance.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
513A-8 as follows:
 
6    (105 ILCS 5/13A-8)
7    Sec. 13A-8. Funding.
8    (a) The State of Illinois shall provide funding for the
9alternative school programs within each educational service
10region and within the Chicago public school system by line item
11appropriation made to the State Board of Education for that
12purpose. This money, when appropriated, shall be provided to
13the regional superintendent and to the Chicago Board of
14Education, who shall establish a budget, including salaries,
15for their alternative school programs. Each program shall
16receive funding in the amount of $30,000 plus an amount based
17on the ratio of the region's or Chicago's last best 3 years'
18months' average daily attendance in grades 6 pre-kindergarten
19through 12 of pupils served by the alternative school program
20to the statewide totals of these amounts. For purposes of this
21calculation, the best 3 months' average daily attendance for
22each region or Chicago shall be calculated by adding to the
23best 3 months' average daily attendance the number of

1low-income students identified in the most recently available
2federal census multiplied by one-half times the percentage of
3the region's or Chicago's low-income students to the State's
4total low-income students. The State Board of Education shall
5retain up to 1.1% of the appropriation to be used to provide
6technical assistance, professional development, and
7evaluations for the programs.
8    (a-5) Notwithstanding any other provisions of this
9Section, for the 1998-1999 fiscal year, the total amount
10distributed under subsection (a) for an alternative school
11program shall be not less than the total amount that was
12distributed under that subsection for that alternative school
13program for the 1997-1998 fiscal year. If an alternative school
14program is to receive a total distribution under subsection (a)
15for the 1998-1999 fiscal year that is less than the total
16distribution that the program received under that subsection
17for the 1997-1998 fiscal year, that alternative school program
18shall also receive, from a separate appropriation made for
19purposes of this subsection (a-5), a supplementary payment
20equal to the amount by which its total distribution under
21subsection (a) for the 1997-1998 fiscal year exceeds the amount
22of the total distribution that the alternative school program
23receives under that subsection for the 1998-1999 fiscal year.
24If the amount appropriated for supplementary payments to
25alternative school programs under this subsection (a-5) is
26insufficient for that purpose, those supplementary payments

1shall be prorated among the alternative school programs
2entitled to receive those supplementary payments according to
3the aggregate amount of the appropriation made for purposes of
4this subsection (a-5).
5    (b) An alternative school program shall be entitled to
6receive general State aid as calculated in subsection (K) of
7Section 18-8.05 upon filing a claim as provided therein. Any
8time that a student who is enrolled in an alternative school
9program spends in work-based learning, community service, or a
10similar alternative educational setting shall be included in
11determining the student's minimum number of clock hours of
12daily school work that constitute a day of attendance for
13purposes of calculating general State aid.
14    (c) An alternative school program may receive additional
15funding from its school districts in such amount as may be
16agreed upon by the parties and necessary to support the
17program. In addition, an alternative school program is
18authorized to accept and expend gifts, legacies, and grants,
19including but not limited to federal grants, from any source
20for purposes directly related to the conduct and operation of
21the program.
