settlement proceeds.

AMENDMENT NO. 1. Amend House Bill 1628 by replacing the title
with the following:
"AN ACT to provide for the deposit of funds received from
settlement of litigation against tobacco companies."; and
by replacing everything after the enacting clause with the following:
"Section 5. The State Finance Act is amended by adding Sections
5.540 and 6z-43 as follows:
(30 ILCS 105/5.540 new)
Sec. 5.540. The Tobacco Settlement Recovery Fund.
(30 ILCS 105/6z-43 new)
Sec. 6z-43. Tobacco Settlement Recovery Fund. There is created
in the State Treasury a special fund to be known as the Tobacco
Settlement Recovery Fund into which shall be deposited all monies
paid to the State pursuant to (1) the Master Settlement Agreement
entered in the case of People of the State of Illinois v. Philip
Morris, et al. (Circuit Court of Cook County, No. 96-L13146) and (2)
any settlement with or judgment against any tobacco product
manufacturer other than one participating in the Master Settlement
Agreement in satisfaction of any released claim as defined in the
Master Settlement Agreement, as well as any other monies as provided
by law. All earnings on Fund investments shall be deposited into the
Fund. Upon the creation of the Fund, the State Comptroller shall
order the State Treasurer to transfer into the Fund any monies paid
to the State as described in item (1) or (2) of this Section before
the creation of the Fund plus any interest earned on the investment
of those monies.
Section 99. Effective date. This Act takes effect upon becoming
law.".

Representatives that the Senate has adopted the following Senate
Joint Resolution, in the adoption of which I am instructed to ask the
concurrence of the House of Representatives, to-wit:
SENATE JOINT RESOLUTION NO. 45
WHEREAS, Illinois' 76,000 farmers are the stewards of much of our
land base and grow the crops and livestock we all rely on for food,
while maintaining open space, scenic views, and wildlife habitat and
together comprise Illinois' leading industry; and
WHEREAS, In many parts of Illinois prime farmland faces intense
development pressure; and
WHEREAS, It is critically important for Illinois to develop sound
and balanced public policies that address farmland and open space
needs while preserving the availability and affordability of housing
for our citizens; and
WHEREAS, The development of sound land use, housing, and

transportation policies would be enhanced by bringing together public
officials and private organizations who are dedicated to dealing
effectively with these issues; and
WHEREAS, Better planning could guide new development to locations
where public infrastructure is already in place or nearby, thus
reducing damage to the environment and helping sustain our rural
heritage; therefore be it
RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL ASSEMBLY OF
THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES CONCURRING
HEREIN, that there is created the Illinois Growth Task Force:
(a) The Task Force consists of at least 12 members and not more
than 24 members chosen according to the following requirements:
(1) Six voting members appointed from the House of
Representatives, with 3 members appointed by the Speaker and 3
members appointed by the Minority Leader;
(2) Six voting members appointed from the Senate, with 3
members appointed by the President and 3 members appointed by the
Minority Leader;
(3) Up to 12 non-voting members appointed from pertinent
fields or disciplines by the legislative members of the Task Force,
by majority vote, from the following categories:
(A) Agriculture;
(B) Environment;
(C) Local government;
(D) Real estate;
(E) Regional planning;
(F) Building trades and construction;
(G) Business;
(b) A majority of the legislative appointees shall select a
legislative member of the Task Force to serve as chairperson;
(c) The Lieutenant Governor, the Director of Agriculture, the
Director of Commerce and Community Affairs, the Director of the
Environmental Protection Agency, the Director of Natural Resources,
the Secretary of Transportation, and the Chairman of the Illinois
Housing Development Authority, or their designees, shall serve as
advisory non-voting delegates to the Task Force;
(d) The legislative members may appoint a Planning Committee
consisting of non-voting, advisory members to assist with the Task
Force;
(e) The Task Force has the following objectives:
(1) Conduct a series of public hearings throughout the State
to discuss with citizens in different regions their visions and plans
for Illinois in the 21st Century with respect to land use, housing
and transportation priorities, and the preservation of open space,
farmland, and natural areas;
(2) Develop a set of statewide land use, housing, and
transportation goals, based on the testimony of citizens at the task
force hearings around Illinois;
(3) Propose enabling legislation and identify revenue
sources and incentives to meet the goals of the Task Force;
(4) Review existing State statutes affecting farmland and
development to identify gaps and duplications;
(5) Review State and regional land use and transportation
policies and priorities to determine their impact on regional
development patterns, farmland, agriculture, open space, and housing,
and recommend appropriate changes in policy and funding priorities;
(6) Review State and regional land use, planning, and zoning
policies to determine their impact on agriculture, open space, and
housing, and recommend appropriate changes in policy and funding
priorities to promote balanced growth;
(7) Review the policies and programs of other states to

identify successful legislative and policy initiatives that could be
adapted for Illinois to ensure sustainable growth in the 21st
century;
(8) Discuss formation of a permanent working group or
commission on growth issues, including designation of a lead State
agency;
(f) The Task Force shall receive the assistance of legislative
staff, legislative agencies, and, upon request, private and public
organizations;
(g) The members of the Task Force shall serve without
compensation but be reimbursed for their reasonable and necessary
expenses from funds appropriated for that purpose; and be it further
RESOLVED, That the Illinois Growth Task Force shall meet as soon
as possible after at least 9 legislative members have been appointed,
shall hold public hearings, and shall report its findings and
recommendations to the General Assembly by filing a copy of its
report with the Secretary of the Senate and the Clerk of the House;
and that upon filing its report the task force is dissolved.

WHEREAS, The members of the Illinois House of Representatives are
saddened to learn of the death of James Zacharias of Winnetka,
Illinois, who recently passed away; and
WHEREAS, James Zacharias was born in Oak Park, Illinois; he
graduated from the University of Chicago College, and graduated from
the University of Chicago Law School in 1935; he entered the United
States Army in 1942, serving in World War II; and
WHEREAS, Before his military service, Mr. Zacharias practiced law
for 3 years and operated a plastics company; after his tour of duty
ended he and his brother, Richard, operated Precision Plating Co., an
electroplating firm, where he retired from in 1989; and
WHEREAS, Mr. Zacharias and his brother teamed up with the
Stefanos family, creators of the Dove Bar, to introduce the chocolate
and ice cream confection to a national market; and
WHEREAS, James Zacharias had served on the Illinois ACLU board of
directors since 1983, and on the executive committee since 1990; in
1994 he became the chairman of the advisory committee; Mr. Zacharias
was a past chairman of the Illinois Commission on Children and the
John Howard Association, a prison reform group; he was the first
chair of the Cook County Special Bail Project, and created the
Zacharias Center in Gurnee for the Lake County Council Against Sexual
Assault; and

WHEREAS, His compassion, intellect, and idealism were selflessly
shared with those who often did not have a powerful public voice; and
WHEREAS, James Zacharias is survived by his wife, Bobette Blum
Zacharias; his son, Jamie; his daughters, Joan Dorothy Zacharias and
Laurie Rose Zacharias-Smith; his grandchild, and his
great-grandchild; therefore, be it

WHEREAS, The members of the Illinois House of Representatives are
saddened to learn of the death of former State Representative Abraham
Lincoln Stanfield, formerly of Chrisman, Illinois; and
WHEREAS, Abraham Lincoln Stanfield, known as "Lincoln", "Link",
and "Abe", was born in Edgar, Illinois, on August 7, 1911; his
parents were Donald Dakin and Mayme Henderson Stanfield; Mr.
Stanfield was State Representative for the 51st District from 1957 to
1963; and
WHEREAS, Mr. Stanfield graduated from Chrisman High School in
1928 and Kemper Military School in 1930; he received a Bachelor of
Science degree from Eastern Illinois University in 1962 and a Masters
of Science degree from Southern Illinois University in 1968; and
WHEREAS, Mr. Stanfield was the owner of an insurance agency and a
hardware store in Kansas, Illinois; he also served as a Boy Scout
leader in Kansas for 10 years; he served as the Edgar County
Treasurer and Deputy County Coroner and was employed in the county
clerk's office; and
WHEREAS, Mr. Stanfield taught school at East Junior High School
in Kankakee for 5 years; after his move to Arizona, he taught at
Camelback High School, West High School, and Paradise Valley
Community College; he was the tennis coach for West High, North High,
and Paradise Valley High School; and
WHEREAS, Mr. Stanfield was a member of Emmanuel Presbyterian
Church in Phoenix, Arizona, the Masonic Lodge of Kansas, Illinois,
the Danville Consistery, the Ainad Shrine of Springfield, and the
American Rose Society; and
WHEREAS, Abraham Lincoln Stanfield is survived by his wife,
Phyliis; his son, Pat Stanfield; his grandchildren, Michael
Stanfield, Dr. Laura Stanfield Prichard, Jason Stanfield, Lucy
Stanfield, and Lisa Stanfield; his brother-in-law and sister-in-law,
Eldon and Jane Garrett; his sister, Peg Petitt; his niece, Peggy
Jensen; and his two nephews, Col. James M. Petitt III and John McGee;

HOUSE RESOLUTION 464

WHEREAS, The members of this House are pleased and honored to
recognize individuals who have made great achievements in the world
of education; and
WHEREAS, It has come to our attention that Dr. Thomas E. Ryan,
Superintendent of Schools for Community Consolidated Schools,
District 168 of Sauk Village, has been chosen for the honor of having
the six-classroom addition of Wagoner School dedicated to him and
called the Dr. Thomas E. Ryan Learning Center; and
WHEREAS, Dr. Ryan completed his doctoral dissertation, which was
entitled "Parents as Partners", and has been very active in promoting
parent involvement in their child's academic lives; and
WHEREAS, Dr. Ryan has served as a teacher, principal,
comptroller, assistant superintendent, and associate superintendent
in charge of finance, operations, and personnel throughout the
districts in southern Cook County; and
WHEREAS, Dr. Ryan has developed and implemented budgets and
financial plans where he has served, which have led to those
districts being removed from the State's "Financial Watch List"
within two years of implementation; and
WHEREAS, Dr. Ryan has presented at numerous district and State
I.A.S.B. workshops and seminars regarding the topic of real parent
involvement, school finance, and safety related issues; he has served
as a consultant to the I.A.S.B. on numerous superintendent business
officials' searches; and
WHEREAS, He has been affiliated with several organizations,
including Phi Delta Kappa, the Illinois Association of School
Business Officials, Northern Superintendents Roundtable, SPEED
Special Education Cooperative, Illinois Association of School
Administrators, American Association of School Administrators,
Educational League of Illinois, S.M.A. Board of Trustees, and ISC 4
Board of Directors; and
WHEREAS, He was recently elected president of the South Cook
Division of the Illinois Association of School Administrators; and
WHEREAS, It is a pleasure and honor to recognize Dr. Thomas E.
Ryan on this occasion; therefore, be it

WHEREAS, The football team of Illinois State University earned
its first Gateway Football Conference title in school history; and
WHEREAS, The team completed its conference schedule with a
perfect 6-0 record and an undefeated home season; and
WHEREAS, The football Redbirds set a school record for
consecutive weeks ranked in the N.C.A.A. 1-AA top 25, including a #5
ranking, the highest in school history; and
WHEREAS, Three players were named to the GTE All-District V
academic team, the most players of any institution in Illinois; and
WHEREAS, Illinois State has set or tied 49 school records in Todd
Berry's four seasons as head coach; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate the
players, Coach Todd Berry, his staff, and all of those associated
with the Illinois State University football program on these

HOUSE RESOLUTION 468
Offered by Representative Hannig:
WHEREAS, The members of the Illinois House of Representatives are
pleased to honor milestones in the State of Illinois; and
WHEREAS, In 1899 Hough Funeral Home began a century of caring;
Roscoe M. "Bally" Hough obtained his license from the National School
of Embalming in St. Louis; he began his career with O.F. Gauer of
Morrisonville; while in Morrisonville he met his future wife, Clara,
and together they started on their new business venture; and
WHEREAS, After the death of Roscoe Hough in 1939, his son,
Robert, took over the family business; Robert received his embalmer
license in 1940 from Worsham College of Mortuary Science and his
funeral director's license in 1941; Robert's son, Bill, received his
license in 1975 from Worsham College of Mortuary Science and
continued the family business; and
WHEREAS, In addition to funeral homes, the Hough family also
operated an ambulance service and were dispatchers for the
Raymond-Harvel, Farmersville-Waggoner, and Morrisonville-Palmer
police and fire departments; the family also expanded the business by
adding three additional locations; and
WHEREAS, In 1994 Daniel and David Hough, the sons of Bill Hough,
continued in the family business when they received degrees from the
Mortuary Department of Forrest Park College in St. Louis; and
WHEREAS, On October 1, 1999, the Hough Funeral Home was honored
by the Illinois Historical Society for sustaining at least 100 years

WHEREAS, Allie Mae Flowers McDonald confessed faith in Jesus
Christ at an early age at Mount Olive Baptist Church in Carthage,
Mississippi; she was married to Quincy McDonald, Sr., for 47 years
and together they had 11 children; and
WHEREAS, Allie Mae Flowers McDonald will be remembered for being
a good mother, a good listener, and an excellent cook; she loved to
play cards, spend time with her family and friends, and was known to
the children in her neighborhood as "Ms. Mac"; and
WHEREAS, Allie Mae Flowers McDonald is survived by her husband,
Quincy McDonald, Sr.; her children, Lula, Frankie (Joe), Deloris
(Lawrence), Odis (Karen), Florence (William), Janice (Norman),

Association of Illinois, the National Recreation and Park
Association, the North American Association for Environmental
Education, and the South Suburban Park and Recreation Professional

WHEREAS, This year marks the 20th anniversary of the Chicago
Association of Neighborhood Development Organizations; and
WHEREAS, As a coalition of community economic development
practitioners, CANDO brings a wealth of experience and innovation to
neighborhood development in Chicago; and
WHEREAS, CANDO's members were concerned about the lack of access
to financing in their neighborhoods and banded together to suggest
issues that affected their ability to revitalize their commercial
strips; and
WHEREAS, They started with the storefront Facade Rebate program
and advocated successfully with the City of Chicago for program
implementation; they designed Neighborhood Lending Programs with
First Chicago, Harris Bank, and the Northern Trust, thus making
millions of dollars available for local projects; and
WHEREAS, The State of Illinois awarded funds for Small Business
Development Centers to CANDO in 1985, and in that same year CANDO
produced its first Neighborhood Retail Portfolio and marketed
neighborhood retail areas in 1986 at its first Neighborhood Retail
Fair; and
WHEREAS, For the tenth anniversary, CANDO developed and marketed
the Neighborhood Investment Campaign, proposing specific solutions
for neighborhood economic problems such as tax reactivation for
economic development, and in 1992, with the State Treasurer and
eighteen local banks, established a microloan program for new and
emerging businesses; and
WHEREAS, In 1993, CANDO's board decided that low and moderate
income communities were not represented in the coalition; they
decided to create the Demonstrating Enabling and Empowering

Development program (DEED) to address their needs and the
organizations working to revitalize them; and
WHEREAS, CANDO started out with a membership of eight, and in
1995 their membership reached the two hundred mark; and
WHEREAS, During the last five years, DEED partnered with

Park, Near South, West Pullman, and Auburn-Gresham; and
WHEREAS, The work of CANDO still goes on, with much difficulty;
today, there is a greater understanding of the importance of building
on concepts, skills, and capacity in order to arrive at a place where
an organization engages in its own development activities; therefore,

WHEREAS, The members of the House were saddened to learn of the
recent death of Mayor Ken Hayes of Bradley; and
WHEREAS, He was elected mayor in 1981 and was re-elected in 1985,
1989, 1993, and 1997; and
WHEREAS, He was born in Limestone Township on August 30, 1924,
the son of Patrick and Catherine Hayes; the family moved to Bradley
when he was three months old, and until his death he lived in the
house that his father bought; and
WHEREAS, He attended St. Joseph's Grammar School and
Bradley-Bourbonnais Community High School; he served in the United
States Army's 83rd Division, 331st Infantry, Company L during World
War II; he won the Silver Star, the Bronze Star with clusters for
meritorious service, a Good Conduct medal, the European Theatre of
Operations medal for five campaigns, and the Croix de Guerre for
service to France; and
WHEREAS, When he returned from war, Ken Hayes became a precinct
captain and then a committeeman; he was elected vice-chairman of the
Democratic Central Committee in Kankakee County in 1966 and served in
that role until 1972, when he was elected central committee chairman;
and
WHEREAS, When he arrived home from the Army, he worked in the
pipefitter's union local until he had a heart attack in 1963, which
led him to quit his trade; he went to work inspecting seed for the
Illinois Department of Agriculture and later worked for then
Secretary of State Alan Dixon; and
WHEREAS, He went to work for the Illinois Secretary of State and
retired with a disability pension after a heart bypass operation in
1978; and
WHEREAS, He was the founder of the Area Jobs Development
Association, active in scouting, golfing, the Bradley Lions, and a
life member of the Bradley VFW; and
WHEREAS, Under Mayor Hayes' strong leadership, the Village of
Bradley experienced unprecedented commercial and retail growth
amounting to large increases in sales tax revenue to Bradley; and
WHEREAS, He was a member of the Loyal Order of the Moose Lodge of
Bradley, one of the vice presidents of the Illinois Municipal League,
and a member of the Mayors Association; and
WHEREAS, His passing will be deeply felt by his family and

friends, especially his wife, Rose; his son Patrick Hayes and his
fiancee Susana Schwengber; his son and daughter-in-law, Tim and Gina
Hayes; his daughters and sons-in-law, Kathy and Ray Polach and Gail

Justin and Elizabeth Polach, and David and Amanda Schultz; therefore,

Sec. 14-15. Certificate of error; counties of 3,000,000 or more.
(a) In counties with 3,000,000 or more inhabitants, if, after
the assessment is certified pursuant to Section 16-150, but subject
to the limitations of subsection (c) of this Section, the county
assessor discovers an error or mistake in the assessment, the
assessor shall execute a certificate setting forth the nature and
cause of the error. The certificate when endorsed by the county
assessor, or when endorsed by the county assessor and board of
appeals (until the first Monday in December 1998 and the board of
review beginning the first Monday in December 1998 and thereafter)
where the certificate is executed for any assessment which was the
subject of a complaint filed in the board of appeals (until the first
Monday in December 1998 and the board of review beginning the first
Monday in December 1998 and thereafter) for the tax year for which
the certificate is issued, may, either be certified according to the
procedure authorized by this Section or be presented and received in
evidence in any court of competent jurisdiction. Certification is
authorized, at the discretion of the county assessor, for: (1)
certificates of error allowing homestead exemptions pursuant to
Sections 15-170, 15-172, and 15-175; (2) certificates of error on
residential property of 6 units or less; (3) certificates of error
allowing exemption of the property pursuant to Section 14-25; and (4)
other certificates of error reducing assessed value by less than
$100,000. Any certificate of error not certified shall be presented
to the court. The county assessor shall develop reasonable procedures
for the filing and processing of certificates of error. Prior to the
certification or presentation to the court, the county assessor or
his or her designee shall execute and include in the certificate of
error a statement attesting that all procedural requirements
pertaining to the issuance of the certificate of error have been met
and that in fact an error exists. When so introduced in evidence such
certificate shall become a part of the court records, and shall not
be removed from the files except upon the order of the court.
Certificates of error that will be presented to the court shall
be filed as an objection in the application for judgment and order of
sale for the year in relation to which the certificate is made or as
an amendment to the objection under subsection (b). Certificates of
error that are to be certified according to the procedure authorized
by this Section need not be presented to the court as an objection or
an amendment under subsection (b). The State's Attorney of the county
in which the property is situated shall mail a copy of any final
judgment entered by the court regarding any certificate of error to
the taxpayer of record for the year in question.
Any unpaid taxes after the entry of the final judgment by the
court or certification on certificates issued under this Section may
be included in a special tax sale, provided that an advertisement is
published and a notice is mailed to the person in whose name the
taxes were last assessed, in a form and manner substantially similar
to the advertisement and notice required under Sections 21-110 and
21-135. The advertisement and sale shall be subject to all
provisions of law regulating the annual advertisement and sale of
delinquent property, to the extent that those provisions may be made
applicable.
A certificate of error certified under this Section shall be
given effect by the county treasurer, who shall mark the tax books
and, upon receipt of one of the following certificates from the
county assessor or the county assessor and the board of review where
the board of review is required to endorse the certificate of error,
shall issue refunds to the taxpayer accordingly:

I, .................., county assessor, hereby certify that the

issued to correct an error or mistake in the assessment."
"CERTIFICATION

correct an error or mistake in the assessment and that any
certificates of error required to be endorsed by the board of
review have been so endorsed."
The county treasurer has the power to mark the tax books to
reflect the issuance of certificates of error certified according to
the procedure authorized in this Section for certificates of error
issued under Section 14-25 or certificates of error issued to and
including 3 years after the date on which the annual judgment and
order of sale for that tax year was first entered. The county
treasurer has the power to issue refunds to the taxpayer as set forth
above until all refunds authorized by this Section have been
completed.
To the extent that the certificate of error obviates the
liability for nonpayment of taxes, certification of a certificate of
error according to the procedure authorized in this Section shall
operate to vacate any judgment or forfeiture as to that year's taxes,
and the warrant books and judgment books shall be marked to reflect
that the judgment or forfeiture has been vacated.
(b) Nothing in subsection (a) of this Section shall be construed
to prohibit the execution, endorsement, issuance, and adjudication of
a certificate of error if (i) the annual judgment and order of sale
for the tax year in question is reopened for further proceedings upon
consent of the county collector and county assessor, represented by
the State's Attorney, and (ii) a new final judgment is subsequently
entered pursuant to the certificate. This subsection (b) shall be
construed as declarative of existing law and not as a new enactment.
(c) No certificate of error, other than a certificate to
establish an exemption under Section 14-25, shall be executed for any
tax year more than 3 years after the date on which the annual
judgment and order of sale for that tax year was first entered,
except that during calendar years 1999 and 2000 a certificate of
error may be executed for any tax year, provided that the error or
mistake in the assessment was discovered no more than 3 years after
the date on which the annual judgment and order of sale for that tax
year was first entered.
(d) The time limitation of subsection (c) shall not apply to a
certificate of error correcting an assessment to $1, under Section
10-35, on a parcel that a subdivision or planned development has
acquired by adverse possession, if during the tax year for which the
certificate is executed the subdivision or planned development used
the parcel as common area, as defined in Section 10-35, and if
application for the certificate of error is made prior to December 1,
1997.
(e) The changes made by this amendatory Act of the 91st General
Assembly apply to certificates of error issued before, on, and after
the effective date of this amendatory Act of the 91st General
Assembly.

HOUSE BILLS ON SECOND READING
HOUSE BILL 2920. Having been read by title a second time on
earlier today, and held on the order of Second Reading, the same was
again taken up.
Representative Moffitt offered the following amendment and moved
its adoption:
AMENDMENT NO. 2 TO HOUSE BILL 2920
AMENDMENT NO. 2. Amend House Bill 2920, AS AMENDED, in Section
5, Sec. 10-26, by replacing all of subsection (e) with the following:
"(e) This subsection applies to support payments received by the
State Disbursement Unit on or after October 1, 1999 and applies only
to support payments required to be processed by the State
Disbursement Unit as provided in this Section.
If the State Disbursement Unit fails to disburse a support
payment to the person entitled to the payment within the time frame
prescribed by federal guidelines, then that person is entitled to a
civil penalty payment in addition to the support payment. The civil
penalty payment shall be paid from moneys allocated by the Illinois
Department for the operation of the State Disbursement Unit under the
agreement described in subsection (a). The amount of the civil
penalty payment shall be 2% of the amount of the support payment for
each 30-day period or fraction of such a period that the support
payment was not disbursed within the time frame prescribed by federal
guidelines. A person is entitled to a civil penalty payment under
this subsection for each support payment that was not disbursed to
the person within the time frame prescribed by federal guidelines.
A person entitled to a civil penalty payment under this
subsection must apply to the State Disbursement Unit for the payment.
The State Disbursement Unit shall determine whether an applicant for
a civil penalty payment is eligible for the payment based solely on
whether the State Disbursement Unit failed to disburse a support
payment to the applicant within the time frame prescribed by federal
guidelines. If the State Disbursement Unit determines that an
applicant for a civil penalty payment is eligible for the payment,
the State Disbursement Unit shall determine the amount of the
payment.".
The motion prevailed and the amendment was adopted and ordered
printed.
There being no further amendments, the foregoing Amendment No. 2
was ordered engrossed; and the bill, as amended, was advanced to the
order of Third Reading.
