WHEREAS, It has come to our attention that Flavia Hernandez,
Principal of Josefa Ortiz de Dominguez School, was a recipient of the
Chicago Principals and Administrators Associations' 1999 Outstanding
Leadership Award; and
WHEREAS, Flavia Hernandez has been with the Chicago Public
Schools for fifteen years; she has been an elementary school teacher
and is the former Principal of Salazar Bilingual Education Center;
and
WHEREAS, She taught Adult English as a second language; she
currently provides this service at Ortiz de Dominguez to 50 parents;
she created a day care service for 65 children to allow parents to
take classes; and
WHEREAS, She is also a former Catholic school teacher; she taught
at Blessed Agnes Grade School; and
WHEREAS, Her wise counsel and advice was a great influence on her
students, and she soon earned the respect and affection of students,
teachers, and staff; therefore, be it

HOUSE RESOLUTION 303
Offered by Representative Curry:
WHEREAS, The federal Clean Air Act requires a new type of motor
fuel to be sold in the Nation's ozone non-attainment areas beginning
January 1, 2000; and
WHEREAS, This new fuel is known as Phase II Reformulated Gasoline
or RFG; and
WHEREAS, Illinois has 2 ozone non-attainment areas: the 8-county
Chicago Metropolitan area which will have to sell Phase II RFG
exclusively and the 3-county Metro-east area; and
WHEREAS, Most of the present Phase I RFG fuel sold in the Chicago
Metropolitan area, through a partnership between corn growers,

ethanol processors, and gasoline refiners and marketers, contains 10%
ethanol; and
WHEREAS, The Chicago RFG market accounts for 400 million gallons
of ethanol demand, making it the foundation of the domestic ethanol
industry today; and
WHEREAS, The General Assembly is greatly concerned that present
United States Environmental Protection Agency regulations for Phase
II RFG could severely limit or prohibit the blending of ethanol in
gasoline by refiners, especially in the summer months, thereby
endangering the Illinois ethanol industry's core market; and
WHEREAS, To date, the Chicago Area and Illinois have made
extraordinary progress in meeting the demands of the Clean Air Act,
leading to greatly improved air quality, much of which is attributed
to the use of existing RFG fuels; and
WHEREAS, The USEPA's proposed Phase II RFG regulations for
January 1, 2000, constitute a real threat to the economic viability
of Illinois' ethanol industry and Illinois' gasoline refining
industry; and
WHEREAS, Illinois' ethanol industry supports over 50,000 jobs in
the corn farming and ethanol processing sector, with major facilities
in Peoria, Decatur, and elsewhere in the State; and
WHEREAS, Illinois' gasoline refining and marketing industry
employs over 40,000 Illinois workers, including 6 major refineries
producing over one million barrels a day of gasoline and other
products in the Chicago area, St. Louis area, and Southeastern
Illinois locations; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we encourage and
support Governor George Ryan's decision to immediately engage the
Administrator of the United States Environmental Protection Agency in
a dialogue towards meeting and resolving the technical challenges of
using ethanol in Phase II RFG; that the dialogue shall include
presentation of recent research data suggesting ethanol benefits and
the request that the U.S. Environmental Protection Agency permit the
continued use of ethanol under phase II of the RFG Program in a way
that will not economically disadvantage Illinois' ethanol and
gasoline refining industries; and be it further
RESOLVED, That if urban airshed modeling is required as a
necessary component of the presentation to the U.S. Environmental
Protection Agency, the General Assembly will support funding for the
Illinois EPA to conduct the modeling; and be it further
RESOLVED, That suitable copies of this resolution be delivered to
the Governor, the Director of the Illinois Environmental Protection
Agency, the Administrator of the United States Environmental
Protection Agency, the President of the United States, and each
member of the Illinois congressional delegation.
HOUSE RESOLUTION 304

WHEREAS, The State of Illinois is experiencing the lowest
unemployment in over two decades with many sectors of the Illinois
economy experiencing severe labor shortages; and
WHEREAS, The State of Illinois is home to some of the nation's
top businesses and business sectors including: manufacturing,
technology, agri-business, retail, hospitality and visitor industry,
biotechnology, and health care; and
WHEREAS, Many sectors of Illinois' economy are increasingly
relying upon new American immigrants to meet the challenges of severe
labor shortages; and
WHEREAS, The State of Illinois is home to outstanding

post-secondary institutions experienced in the education of adults of
all ages, races, ethnicities, and walks-of-life; and

GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we respectfully
request that the Board of Higher Education, the Illinois Community

examine the issue of the most appropriate venue and agenda for adult
education in the State of Illinois; and be it further

BE IT RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE
CONCURRING HEREIN, that there is created the Manufactured Housing
Task Force consisting of 16 members as follows: the Director of
Public Health or his or her designee; the Director of the
Environmental Protection Agency or his or her designee; the President
of the American Association of Retired Persons or his or her
designee; the President of the Mobile Home Owners Association or his
or her designee; the Chairman of the Illinois Manufactured Housing
Association or his or her designee; the President of the Illinois
Housing Institute or his or her designee; 4 members appointed by the
Speaker of the House of Representatives, including at least one
manufactured home park owner who has owned a park community for at
least 5 years and at least one manufactured home tenant who has
resided in a manufactured home community for at least 5 years; 4
members appointed by the Minority Leader of the House of
Representatives, including at least one manufactured home park owner
who has owned a park community for at least 5 years and at least one
manufactured home tenant who has resided in a manufactured home
community for at least 5 years; one member of the House appointed by
the Speaker of the House of Representatives and one member of the
Senate appointed by the Minority Leader of the House of
Representatives; and be it further
RESOLVED, That the Task Force shall meet initially at the call of
the Speaker and the Minority Leader of the House of Representatives,
shall select one member as chairperson at its initial meeting, and
shall meet thereafter at least 3 times a year and at the call of the
chairperson; and be it further
RESOLVED, That the members of the Task Force shall serve one year
terms and shall serve without compensation but shall be reimbursed
for their reasonable and necessary expenses by the Environmental
Protection Agency from funds appropriated to the Agency for that
purpose; and be it further
RESOLVED, That the Task Force shall submit a report one year
after its initial meeting to the House and Senate by filing copies of
its report with the Clerk of the House and the Secretary of the
Senate; the report shall address the following manufactured housing
issues: eviction procedures, methods of increasing acceptability of
manufactured housing as affordable and acceptable housing, zoning
easements, low-interest loans, weather safety issues, and other

HOUSE JOINT RESOLUTION 25
Offered by Representative Parke:
WHEREAS, PA 90-41 includes necessary consumer and fair market
protections, such as requiring the separation of lending and
insurance transactions; prohibitions against coercive practices and
anti-tying; requiring separate lending and insurance areas;
requirements for full written disclosures to customers; and inclusion
of prohibitions against sharing confidential information; and
WHEREAS, HB 586 was supported by the Illinois Bankers
Association, the Community Bankers Association of Illinois, the
Professional Independent Insurance Agents of Illinois, the Illinois
Life Underwriters Association, the Illinois League of Financial
Institutions, the Illinois Credit Union System, the Illinois
Insurance Association and the Illinois Life Insurance Council; and
WHEREAS, The Comptroller of the Currency is an appointed, federal
bureaucrat who has a track record of promulgating regulations that
serve to expand bank insurance powers; these new insurance
activities, deemed banking issues by the Comptroller, often conflict
with established state laws; and
WHEREAS, On January 13, 1997, the Office of the Comptroller of
the Currency (OCC) issued a request for comments on Rhode Island's
Financial Institution Insurance Sales Act to assist in the
determination as to whether Section 92 of the Federal Bank Act
provided the Comptroller of the Currency sufficient authority to
preempt Rhode Island's banks-in-insurance statute; and
WHEREAS, The McCarran-Ferguson Act of 1945 relegates authority to
the individual states for regulation of the insurance activities of
all entities; and
WHEREAS, The preemption of state insurance laws by an unelected
federal bureaucrat is in direct conflict with the fifty-four year
tradition of state regulation of insurance under McCarran-Ferguson
and thereby raises vitally important questions of states' rights and
the primacy of duly-elected representatives to enact laws governing
insurance activities within their state borders; and
WHEREAS, The National Association of Insurance Commissioners
(NAIC); the National Conference of State Legislators (NCSL); and the
National Conference of Insurance Legislators (NCOIL) all submitted
letters strongly opposing the Comptroller of the Currency's desire to
preempt state insurance law; and
WHEREAS, In past court disputes between federal banking and state
insurance regulators, federal courts have granted "unequal deference"
to federal regulators, thereby rendering decisions based not on the
merits of the case, but on deference to the federal regulator;
therefore, be it
RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF
ILLINOIS, THE SENATE CONCURRING HEREIN, That we memorialize the
Congress of the United States to enact legislation to affirm the
authority of of the states to regulate insurance matters, including
preventing the Office of the Comptroller of the Currency from
preempting state laws regulating the sale of insurance through

lending institutions and ending the practice of federal regulators
being able to be granted "unequal deference" in litigation between
state and federal regulations on insurance matters; and be it further
