1 | | AN ACT concerning criminal law.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the |
5 | | Violent Gun Offender Sentencing Act. |
6 | | Section 5. Purpose. The General Assembly recognizes that a |
7 | | significant amount of gun violence is committed by individuals |
8 | | with prior criminal histories involving violence and firearms. |
9 | | This Act creates data-driven presumptive guidelines within |
10 | | existing sentencing ranges to target the most serious penalties |
11 | | towards offenders who have histories of violence and gun crime, |
12 | | while maintaining judicial discretion in the interest of |
13 | | justice. The goal of these presumptive guidelines is to provide |
14 | | additional guidance to the court, to ensure that sentences for |
15 | | repeat, violent gun offenders reflect the seriousness of those |
16 | | offenses.
