| 1 | | AN ACT concerning transportation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Highway Code is amended by changing |
| 5 | | Section 9-101 as follows:
|
| 6 | | (605 ILCS 5/9-101) (from Ch. 121, par. 9-101)
|
| 7 | | Sec. 9-101.
Nothing in this Code shall prevent the |
| 8 | | execution of cooperative
agreements among governmental |
| 9 | | agencies.
|
| 10 | | Any municipality may negotiate an agreement with the |
| 11 | | Department whereby
the municipality may use such funds as are |
| 12 | | available to it for that purpose
for the construction or |
| 13 | | maintenance of a State highway within its
boundaries or with |
| 14 | | the corporate authority of a county or road district for
the |
| 15 | | construction or maintenance of a highway on the county highway |
| 16 | | system
or township or district road system outside of its |
| 17 | | municipal boundaries.

| 18 | | The county board may negotiate an agreement with the |
| 19 | | Department whereby
the county may use such funds as are |
| 20 | | available to it for that purpose for
the construction or |
| 21 | | maintenance of a highway on the State highway system or
with a |
| 22 | | municipality for the construction or maintenance of streets on |
| 23 | | the
municipal street system of such municipality.
