Amends the Adult Education Act with respect to Area Planning Councils. Makes changes concerning membership on an Area Planning Council, the election of officers and the development of bylaws, the chairperson of the Council, and the designation of sub-areas within a Council district. Requires the Illinois Community College Board to determine the guidelines for the bylaws and operation of a Council. Removes provisions concerning joint Councils and Councils for school districts not included within the boundaries of a community college district. Makes changes concerning an Area Adult Education Plan and the Board's annual report to the Governor and the General Assembly for adult education. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Adult Education Act is amended by changing |
5 | | Section 2-4 as follows:
|
6 | | (105 ILCS 405/2-4) (from Ch. 122, par. 202-4)

7 | | Sec. 2-4. Area Planning Councils. On or before October 15, |
8 | | 1982, an Area
Planning Council shall be established within the |
9 | | boundaries of each
community college district. A |
10 | | representative of each approved adult education provider is |
11 | | required to participate on the Area Planning Council. Other |
12 | | members may include: |
13 | | (1) regional superintendents of schools; |
14 | | (2) representatives of school districts; |
15 | | (3) representatives of the community college |
16 | | district's career and technical education program; |
17 | | (4) representatives of the community college |
18 | | district's financial aid office; |
19 | | (5) representatives of the community college |
20 | | district's student services office; |
21 | | (6) representatives of local workforce boards under |
22 | | the federal Workforce Innovation and Opportunity Act; |
23 | | (7) persons with an interest in adult education |

1 | | services provided within the community college district; |
2 | | and |
3 | | (8) persons with an interest in adult education |
4 | | services provided within the Area Planning Council |
5 | | district, including, but not limited to, representatives |
6 | | of social service agencies, businesses and employers, |
7 | | vocational rehabilitation services of the Department of |
8 | | Human Services, and the Department of Employment Security. |
9 | | Each Area Planning Council must elect officers and develop |
10 | | bylaws that indicate the membership of the Council. The Area |
11 | | Planning Council chairperson must be a representative of an |
12 | | adult education provider approved by the Board. In areas where |
13 | | large multiple-provider Area Planning Councils exist, the |
14 | | Board may designate sub-areas within an Area Planning Council |
15 | | district to ensure maximum representation of need. The Board |
16 | | shall determine the guidelines for the bylaws and operation of |
17 | | the Area Planning Council. Each school district included within |
18 | | the
boundaries
of the community college district maintaining |
19 | | either grades kindergarten
through 12 or grades 9 through 12; |
20 | | each regional superintendent of schools,
the majority of whose |
21 | | region
is included within the boundaries of the community |
22 | | college district; and
the community college district shall be |
23 | | entitled to one representative on
the Area Planning Council. |
24 | | Area Planning Councils may elect to form a joint
Area Planning |
25 | | Council consisting of 2 or more community college
districts
as |
26 | | approved by the Board. School districts which are not included |

the boundaries of a community college district may elect |
2 | | to participate
in an Area Planning Council associated with a |
3 | | community college district
with the approval of the Board; or |
4 | | they may elect to establish an
Area Planning Council which is |
5 | | not associated with a community college district
with the |
6 | | approval of the Board.

7 | | On or before March 1 of each year each Area Planning |
8 | | Council shall submit
an annual Adult Education Plan for the |
9 | | area. The Area Adult Education Plan
shall provide for the |
10 | | development and coordination of adult education programs
in the |
11 | | area as prescribed by the Board . The Area Adult Education Plan |
12 | | must be aligned with Title II of the federal Workforce |
13 | | Innovation and Opportunity Act, the State Unified Plan, local |
14 | | workforce boards, and one-stop activities and must include |
15 | | involvement of the local Board-approved adult education |
16 | | workforce board representative. The local adult education |
17 | | workforce board representative is responsible for convening |
18 | | Area Planning Council chairpersons in a local workforce area to |
19 | | provide information
regarding the development of the Area Adult |
20 | | Education Plans and related federal Workforce Innovation and |
21 | | Opportunity Act activities. If the Board finds that the annual |
22 | | Area Adult Education
Plan submitted by the Area Planning |
23 | | Council meets the requirements of this
amendatory
Act of 1982 |
24 | | and the established standards and guidelines, the Board shall |
25 | | approve the Plan. The approval of adult education
programs
by |
26 | | the Board for reimbursement under Section
10-22.20
of the |

1 | | School Code shall be based on the Adult Education Plan approved |
2 | | for the
Area. The Area Adult Education Plan must be approved |
3 | | prior to funding being made available to an Area Planning |
4 | | Council district.
|
5 | | On or before March 1, 2002 and each year thereafter, the |
6 | | Board shall submit
an annual report to the Governor and the |
7 | | General
Assembly for adult education for the preceding school |
8 | | year. The annual
report shall include a summary of adult |
9 | | education needs and programs; the
number of students served , |
10 | | federal Workforce Innovation and Opportunity Act activities, |
11 | | high school equivalency information, credit hours or units of |
12 | | instruction, performance data, total adult education |
13 | | allocations
costs , and State reimbursement for adult basic |
14 | | education , adult secondary education, English language |
15 | | acquisition, integrated English literacy, civics education, |
16 | | bridge and integrated education
and training programs, and |
17 | | vocational
skills programs; the criteria used for program |
18 | | approval ; and any
recommendations.
