SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/12C-50

    Amends the Criminal Code of 2012 concerning hazing. Changes the elements of hazing. Changes the mental state for hazing from knowingly requiring the performance of any act by another to recklessly, knowingly, or intentionally subjecting a student or other person in a school, college, university, or other educational institution in the State to the risk of bodily or mental harm by performing or requiring the performance of an act, for the purpose of, or as a condition of, conferring, gaining or maintaining acceptance, membership, office, or other status in any group, organization, or society associated or connected with that institution, regardless of the student's or other person's express or implied consent or acquiescence, if: (1) the act or occurrence is neither sanctioned or authorized by that educational institution nor is a customary athletic event or similar contest or competition; and (2) the act or occurrence results in bodily or mental harm to any person.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by changing
5Section 12C-50 as follows:
 
6    (720 ILCS 5/12C-50)
7    Sec. 12C-50. Hazing.
8    (a) A person commits hazing when he or she recklessly,
9knowingly, or intentionally subjects knowingly requires the
10performance of any act by a student or other person in a
11school, college, university, or other educational institution
12in of this State to the risk of bodily or mental harm by
13performing or requiring the performance of an act, for the
14purpose of, or as a condition of, conferring, gaining or
15maintaining acceptance, membership, office, or other status
16in , for the purpose of induction or admission into any group,
17organization, or society associated or connected with that
18institution, regardless of the student's or other person's
19express or implied consent or acquiescence, if:
20        (1) the act or occurrence is neither not sanctioned or
21    authorized by that educational institution nor is a
22    customary athletic event or similar contest or
23    competition; and

1        (2) the act or occurrence results in bodily or mental
2    harm to any person.
3    (b) Sentence. Hazing is a Class A misdemeanor, except that
4hazing that results in death or great bodily harm is a Class 4
5felony.
