2 | | AMENDMENT NO. ______. Amend Senate Bill 3023 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Higher Education Cooperation Act is amended |
5 | | by changing Sections 2, 3, 4, and 5 and by adding Section 2.5 |
6 | | as follows:
|
7 | | (110 ILCS 220/2) (from Ch. 144, par. 282)

8 | | Sec. 2. As used in this Act, unless the context otherwise |
9 | | requires:
|
10 | | "Board" means the Board of Higher Education . ;
|
11 | | "Nonpublic institution of higher education" means a |
12 | | nonpublic college or university that (i) has been authorized to |
13 | | operate within the State of Illinois pursuant to the Private |
14 | | College Act or the Academic Degree Act, (ii) has been in |
15 | | continuous operation and has granted degrees within the State |
16 | | of Illinois since before the effective date of both the Private |

1 | | College Act and the Academic Degree Act and has not modified |
2 | | the business entity since the effective date of both the |
3 | | Private College Act and the Academic Degree Act, or (iii) has |
4 | | been authorized pursuant to the Private Business and Vocational |
5 | | Schools Act of 2012. an educational
organization, other than a |
6 | | public institution of higher education, which
provides a |
7 | | minimum of an organized 2 year program at the private junior |
8 | | college
level or higher and which operates not-for-profit and |
9 | | in conformity with
standards substantially equivalent to those |
10 | | of the public institutions of
higher education;

11 | | "Private partner" means a private business, industry, |
12 | | labor organization, not-for-profit organization, association, |
13 | | foundation, or corporation that partners with one or more |
14 | | public institutions of higher education or with one or more |
15 | | nonpublic institutions of higher education or with both public |
16 | | and nonpublic institutions of higher education pursuant to an |
17 | | agreement under this Act. |
18 | | "Private resources" means support, whether financial or |
19 | | in-kind assistance, from a private partner that may be used to |
20 | | provide matching support under this Act. |
21 | | "Public institution of higher education" means the |
22 | | University of
Illinois, Southern Illinois University,
Chicago |
23 | | State University, Eastern Illinois University, Governors State

24 | | University, Illinois State University, Northeastern Illinois |
25 | | University,
Northern Illinois University, Western Illinois |
26 | | University, the public community
colleges of
this State, and |

other public universities, colleges and community colleges
|
2 | | now or hereafter
established or authorized by the General |
3 | | Assembly.

4 | | "Public-private partnership" means an agreement pursuant |
5 | | to this Act between one or more public institutions of higher |
6 | | education and a nonpublic institution of higher education, a |
7 | | private partner, or a combination of both that leverages |
8 | | resources from all parties to improve higher education |
9 | | outcomes. |
10 | | "Public resources" means support, whether financial or |
11 | | in-kind assistance, from a public entity that may be used to |
12 | | provide matching support under this Act. |

15 | | Sec. 2.5. Purpose. The purpose of this Act is to promote |
16 | | interinstitutional cooperation and public-private partnerships |
17 | | in order to leverage the use of public and private resources to |
18 | | provide workforce-valuable postsecondary education to improve |
19 | | outcomes for the higher educational system in this State.

21 | | Sec. 3.
Any public institution of higher education may |
22 | | participate in the
establishment and operation of programs of |
23 | | interinstitutional cooperation
with other public institutions |
24 | | of higher education , or with nonpublic
institutions of higher |

1 | | education , or with both public and nonpublic
institutions of |
2 | | higher education , or with private partners . Such participation |
3 | | may be by contract or
by other means , including , but not |
4 | | limited to , the designation of
representatives of the |
5 | | institution as directors of not-for-profit
corporations |
6 | | organized for the governance or administration of any such
|
7 | | program. Public institutions of higher education may |
8 | | participate in programs of
interinstitutional cooperation or |
9 | | public-private partnerships that programs which involve |
10 | | institutions or private partners based outside this
State.

13 | | Sec. 4.
A program of financial assistance to programs of |
14 | | interinstitutional
cooperation and public-private |
15 | | partnerships , in higher education is established to implement |
16 | | the policy of
encouraging such cooperation in order to achieve |
17 | | an efficient use of
educational resources, an equitable |
18 | | distribution of educational services,
the development of |
19 | | innovative concepts and applications, and other public
|
20 | | purposes.
|
21 | | The Board of Higher Education shall administer this program |
22 | | of financial
assistance and shall distribute the funds |
23 | | appropriated by the General
Assembly for this purpose in the |
24 | | form of grants to not-for-profit
corporations organized to |
25 | | administer programs of interinstitutional
cooperation in |

1 | | higher education or to public or nonpublic institutions of
|
2 | | higher education participating in such programs .
|
3 | | In awarding grants to interinstitutional programs and |
4 | | public-private partnerships under this Act, the
Board shall |
5 | | consider in relation to each such program whether it serves the
|
6 | | public purposes expressed in this Act, whether the local |
7 | | community is
substantially involved, whether its function |
8 | | could be performed better by a
single existing institution, |
9 | | whether the program is consistent with the
Illinois master plan |
10 | | for higher education, and such other criteria as it
determines |
11 | | to be appropriate.
|
12 | | No grant may be awarded under this Section for any program |
13 | | of sectarian
instruction or for any program designed to serve a |
14 | | sectarian purpose.
|
15 | | As a part of its administration of this Act , the Board may |
16 | | require
audits or reports in relation to the administrative, |
17 | | fiscal , and academic aspects of
any program of |
18 | | interinstitutional cooperation or public-private partnership |
19 | | program for which a grant is awarded under this Act. The Board |
20 | | may require the contribution of matching resources.
The Board |
21 | | shall annually submit to the Governor and the General Assembly |
22 | | a
budgetary recommendation for grants under this Act.

25 | | Sec. 5.
Any not-for-profit corporation organized to |

1 | | administer a program of an
interinstitutional cooperation |
2 | | program of higher education or public-private partnership may |
3 | | be recognized under this
Section if it has been in existence |
4 | | for 3 years or longer, it is structured
for continuing |
5 | | operation, it is substantial in scope, it is oriented to and
|
6 | | supported by the community in which it is located , and it is |
7 | | consistent with
the Illinois master plan for higher education.
|
8 | | In each request of the Board of Higher Education to the |
9 | | General Assembly
for the appropriation of funds for the purpose |
10 | | of making grants under this
Act the Board shall specify the |
11 | | amount of the grant proposed for each
not-for-profit |
12 | | corporation recognized under this Section.
|
13 | | The following not-for-profit corporations are recognized |
14 | | for the
purposes of this Section:
|
15 | | The Quad Cities Graduate Study Center.
