AMENDMENT TO SENATE BILL 3023

2    AMENDMENT NO. ______. Amend Senate Bill 3023 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Higher Education Cooperation Act is amended
5by changing Sections 2, 3, 4, and 5 and by adding Section 2.5
6as follows:
 
7    (110 ILCS 220/2)  (from Ch. 144, par. 282)
8    Sec. 2. As used in this Act, unless the context otherwise
9requires:
10    "Board" means the Board of Higher Education. ;
11    "Nonpublic institution of higher education" means a
12nonpublic college or university that (i) has been authorized to
13operate within the State of Illinois pursuant to the Private
14College Act or the Academic Degree Act, (ii) has been in
15continuous operation and has granted degrees within the State
16of Illinois since before the effective date of both the Private

1College Act and the Academic Degree Act and has not modified
2the business entity since the effective date of both the
3Private College Act and the Academic Degree Act, or (iii) has
4been authorized pursuant to the Private Business and Vocational
5Schools Act of 2012. an educational organization, other than a
6public institution of higher education, which provides a
7minimum of an organized 2 year program at the private junior
8college level or higher and which operates not-for-profit and
9in conformity with standards substantially equivalent to those
10of the public institutions of higher education;
11    "Private partner" means a private business, industry,
12labor organization, not-for-profit organization, association,
13foundation, or corporation that partners with one or more
14public institutions of higher education or with one or more
15nonpublic institutions of higher education or with both public
16and nonpublic institutions of higher education pursuant to an
17agreement under this Act.
18    "Private resources" means support, whether financial or
19in-kind assistance, from a private partner that may be used to
20provide matching support under this Act.
21    "Public institution of higher education" means the
22University of Illinois, Southern Illinois University, Chicago
23State University, Eastern Illinois University, Governors State
24University, Illinois State University, Northeastern Illinois
25University, Northern Illinois University, Western Illinois
26University, the public community colleges of this State, and

1any other public universities, colleges and community colleges
2now or hereafter established or authorized by the General
3Assembly.
4    "Public-private partnership" means an agreement pursuant
5to this Act between one or more public institutions of higher
6education and a nonpublic institution of higher education, a
7private partner, or a combination of both that leverages
8resources from all parties to improve higher education
9outcomes.
10    "Public resources" means support, whether financial or
11in-kind assistance, from a public entity that may be used to
12provide matching support under this Act.

15    Sec. 2.5. Purpose. The purpose of this Act is to promote
16interinstitutional cooperation and public-private partnerships
17in order to leverage the use of public and private resources to
18provide workforce-valuable postsecondary education to improve
19outcomes for the higher educational system in this State.

21    Sec. 3. Any public institution of higher education may
22participate in the establishment and operation of programs of
23interinstitutional cooperation with other public institutions
24of higher education, or with nonpublic institutions of higher

1education, or with both public and nonpublic institutions of
2higher education, or with private partners. Such participation
3may be by contract or by other means, including, but not
4limited to, the designation of representatives of the
5institution as directors of not-for-profit corporations
6organized for the governance or administration of any such
7program. Public institutions of higher education may
8participate in programs of interinstitutional cooperation or
9public-private partnerships that programs which involve
10institutions or private partners based outside this State.

13    Sec. 4. A program of financial assistance to programs of
14interinstitutional cooperation and public-private
15partnerships , in higher education is established to implement
16the policy of encouraging such cooperation in order to achieve
17an efficient use of educational resources, an equitable
18distribution of educational services, the development of
19innovative concepts and applications, and other public
20purposes.
21    The Board of Higher Education shall administer this program
22of financial assistance and shall distribute the funds
23appropriated by the General Assembly for this purpose in the
24form of grants to not-for-profit corporations organized to
25administer programs of interinstitutional cooperation in

1higher education or to public or nonpublic institutions of
2higher education participating in such programs.
3    In awarding grants to interinstitutional programs and
4public-private partnerships under this Act, the Board shall
5consider in relation to each such program whether it serves the
6public purposes expressed in this Act, whether the local
7community is substantially involved, whether its function
8could be performed better by a single existing institution,
9whether the program is consistent with the Illinois master plan
10for higher education, and such other criteria as it determines
11to be appropriate.
12    No grant may be awarded under this Section for any program
13of sectarian instruction or for any program designed to serve a
14sectarian purpose.
15    As a part of its administration of this Act, the Board may
16require audits or reports in relation to the administrative,
17fiscal, and academic aspects of any program of
18interinstitutional cooperation or public-private partnership
19program for which a grant is awarded under this Act. The Board
20may require the contribution of matching resources. The Board
21shall annually submit to the Governor and the General Assembly
22a budgetary recommendation for grants under this Act.

25    Sec. 5. Any not-for-profit corporation organized to

1administer a program of an interinstitutional cooperation
2program of higher education or public-private partnership may
3be recognized under this Section if it has been in existence
4for 3 years or longer, it is structured for continuing
5operation, it is substantial in scope, it is oriented to and
6supported by the community in which it is located, and it is
7consistent with the Illinois master plan for higher education.
8    In each request of the Board of Higher Education to the
9General Assembly for the appropriation of funds for the purpose
10of making grants under this Act the Board shall specify the
11amount of the grant proposed for each not-for-profit
12corporation recognized under this Section.
13    The following not-for-profit corporations are recognized
14for the purposes of this Section:
15    The Quad Cities Graduate Study Center.
