1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||||||||
4 | Section 5. The Higher Education Cooperation Act is amended | ||||||||||||||||||||||||||||||
5 | by changing Sections 2, 3, and 4 and by adding Section 2.5 as | ||||||||||||||||||||||||||||||
6 | follows:
| ||||||||||||||||||||||||||||||

8 | Sec. 2. As used in this Act, unless the context otherwise | ||||||||||||||||||||||||||||||
9 | requires:
| ||||||||||||||||||||||||||||||
10 | "Board" means the Board of Higher Education . ;
| ||||||||||||||||||||||||||||||
11 | "Institution of higher education" means an educational | ||||||||||||||||||||||||||||||
12 | organization that is approved and recognized by the Board of | ||||||||||||||||||||||||||||||
13 | Higher Education and provides workforce valuable postsecondary | ||||||||||||||||||||||||||||||
14 | education. | ||||||||||||||||||||||||||||||
15 | "Private partner" means a business, industry, labor | ||||||||||||||||||||||||||||||
16 | organization, not-for-profit organization, association, | ||||||||||||||||||||||||||||||
17 | foundation, or corporation that partners with institutions of | ||||||||||||||||||||||||||||||
18 | higher education pursuant to an agreement under this Act. | ||||||||||||||||||||||||||||||
19 | "Private resources" means financial support, whether | ||||||||||||||||||||||||||||||
20 | direct or in-kind, from a private partner. | ||||||||||||||||||||||||||||||
21 | "Public-private partnership" means an agreement pursuant | ||||||||||||||||||||||||||||||
22 | to this Act between any combination of institutions of higher | ||||||||||||||||||||||||||||||
23 | education and private partners that leverages resources from |

1 | all parties to improve higher education outcomes. | ||||||
2 | "Public resources" means financial support, whether direct | ||||||
3 | or in-kind, generated from a source of public funds. | ||||||
4 | "Nonpublic institution of higher education" means an | ||||||
5 | educational
organization, other than a public institution of | ||||||
6 | higher education, which
provides a minimum of an organized 2 | ||||||
7 | year program at the private junior college
level or higher and | ||||||
8 | which operates not-for-profit and in conformity with
standards | ||||||
9 | substantially equivalent to those of the public institutions of
| ||||||
10 | higher education;
| ||||||
11 | "Public institution of higher education" means the | ||||||
12 | University of
Illinois, Southern Illinois University,
Chicago | ||||||
13 | State University, Eastern Illinois University, Governors State
| ||||||
14 | University, Illinois State University, Northeastern Illinois | ||||||
15 | University,
Northern Illinois University, Western Illinois | ||||||
16 | University, the public community
colleges of
this State, and | ||||||
17 | any
other public universities, colleges and community colleges
| ||||||
18 | now or hereafter
established or authorized by the General | ||||||
19 | Assembly.

22 | Sec. 2.5. Purpose. The purpose of this Act is to promote | ||||||
23 | interinstitutional cooperation and collaboration, which may | ||||||
24 | involve public-private partnerships leveraging the use of | ||||||
25 | public and private resources to improve outcomes for the higher |

1 | educational system in this State.

3 | Sec. 3.
Any public institution of higher education may | ||||||
4 | participate in the
establishment and operation of programs of | ||||||
5 | interinstitutional cooperation
with other public institutions | ||||||
6 | of higher education or public-private partnerships, or both or | ||||||
7 | with nonpublic
institutions of higher education or with both | ||||||
8 | public and nonpublic
institutions of higher education . Such | ||||||
9 | participation may be by contract or
by other means , including , | ||||||
10 | but not limited to , the designation of
representatives of the | ||||||
11 | institution as directors of not-for-profit
corporations | ||||||
12 | organized for the governance or administration of any such
| ||||||
13 | program. Institutions Public institutions of higher education | ||||||
14 | may participate in
interinstitutional programs or | ||||||
15 | public-private partnerships that which involve institutions or | ||||||
16 | private partners based outside this
State.

19 | Sec. 4.
A program of financial assistance to programs of | ||||||
20 | interinstitutional
cooperation or public-private partnerships, | ||||||
21 | or both , in higher education is established to implement the | ||||||
22 | policy of
encouraging such cooperation in order to achieve an | ||||||
23 | efficient use of
educational resources, an equitable | ||||||
24 | distribution of educational services,
the development of |

| |||||||
1 | innovative concepts and applications, and other public
| ||||||
2 | purposes.
| ||||||
3 | The Board of Higher Education shall administer this program | ||||||
4 | of financial
assistance and shall distribute the funds | ||||||
5 | appropriated by the General
Assembly for this purpose in the | ||||||
6 | form of grants to not-for-profit
corporations organized to | ||||||
7 | administer programs of interinstitutional
cooperation in | ||||||
8 | higher education or to public or nonpublic institutions of
| ||||||
9 | higher education participating in such programs .
| ||||||
10 | In awarding grants to interinstitutional programs or | ||||||
11 | public-private partnerships, or both, under this Act, the
Board | ||||||
12 | shall consider in relation to each such program whether it | ||||||
13 | serves the
public purposes expressed in this Act, whether the | ||||||
14 | local community is
substantially involved, whether its | ||||||
15 | function could be performed better by a
single existing | ||||||
16 | institution, whether the program is consistent with the
| ||||||
17 | Illinois master plan for higher education, and such other | ||||||
18 | criteria as it
determines to be appropriate.
| ||||||
19 | No grant may be awarded under this Section for any program | ||||||
20 | of sectarian
instruction or for any program designed to serve a | ||||||
21 | sectarian purpose.
| ||||||
22 | As a part of its administration of this Act , the Board may | ||||||
23 | require
audits or reports in relation to the administrative, | ||||||
24 | fiscal , and academic aspects of
any interinstitutional program | ||||||
25 | or public-private partnership for which a grant is awarded | ||||||
26 | under this Act. The Board may require matching public or |
| |||||||
| |||||||
1 | private resources from all participants.
The Board shall | ||||||
2 | annually submit to the Governor and the General Assembly a
| ||||||
3 | budgetary recommendation for grants under this Act.
