SYNOPSIS AS INTRODUCED:
 
20 ILCS 5/5-725 new

    Amends the Civil Administrative Code of Illinois. Authorizes and requires a director of any department that issues an occupational or professional license to deny or withhold renewal of such license to a person or business that has failed to pay a debt owed to a county of 3,000,000 or more inhabitants. Provides that this Section does not allow a department to suspend a license not yet subject to renewal, when the aggrieved party is an indigent person, or where the debt does not exceed $50. Allows a department to adopt any rules necessary for the implementation and administration of this Section. Authorizes a director of a department that issues an occupational or professional license to enter into an intergovernmental agreement with the county to establish responsibilities, duties, and procedures relating to the administration of this Section.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Civil Administrative Code of Illinois is
5amended by adding Section 5-725 as follows:
 
6    (20 ILCS 5/5-725 new)
7    Sec. 5-725. Denial of occupational or professional license
8or renewal for debts owed to counties having 3,000,000 or more
9inhabitants.
10    (a) Each director of a department that issues an
11occupational or professional license is authorized to and shall
12withhold an occupational or professional license or the renewal
13of such license to a person or business who has failed to pay
14any fine, assessment of costs, or other sum of money owed to a
15county having 3,000,000 or more inhabitants as ordered by the
16county's Department of Administrative Hearings or a court order
17by the due date indicated in the order or within 35 days of
18becoming a debt due and owing to the county.
19    (b) Notwithstanding the requirements of subsection (a) of
20this Section, nothing in this Section shall be interpreted to
21permit a department to suspend a license not yet subject to
22renewal nor shall a department be required to withhold the
23issuance of an occupational or professional license or the

1renewal of such license where a department is satisfied that
2the aggrieved party is an indigent person or where amounts owed
3do not exceed $50.
4    (c) Subject to the rulemaking provisions of the Illinois
5Administrative Procedure Act, a department may adopt any rules
6necessary for the implementation and administration of this
7Section.
8    (d) Each director of a department that issues an
9occupational or professional license is authorized to enter
10into an intergovernmental agreement with the county to
11establish responsibilities, duties, and procedures relating to
12the administration of this Section.
