1 | | AN ACT concerning public employee benefits.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Pension Code is amended by changing |
5 | | Section 7-155 as follows:
|
6 | | (40 ILCS 5/7-155) (from Ch. 108 1/2, par. 7-155)

7 | | Sec. 7-155. Surviving spouse annuities-commencement. A |
8 | | surviving spouse annuity shall begin on the 1st day of the |
9 | | month
next following the month in which the participating |
10 | | employee, or the
employee annuitant or such person entitled to |
11 | | a retirement annuity died,
upon a written application therefor, |
12 | | provided:
|
13 | | 1. (Blank). Such date is not more than one year prior to |
14 | | the date the
application was received by the Board; and
|
15 | | 2. The amount of surviving spouse annuity before the |
16 | | application of
paragraph 3 of Section 7-158, is at least $5 per |
17 | | month, beginning on
such date.
