AMENDMENT TO SENATE BILL 2570 




2    AMENDMENT NO. ______. Amend Senate Bill 2570 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Illinois Highway Code is amended  by adding 
5Section 4-106 as follows:
 
6    (605 ILCS 5/4-106 new)
7    Sec. 4-106. Misrepresentation.
8    (a) In relation to the submission of plans, maps, 
9specifications, costs of construction, bids, or contracts for 
10any Department project, it is unlawful for the Department, its 
11employees and its agents to knowingly falsify, distort, or 
12misrepresent any facts concerning, but not limited to, the 
13following:
14        (1) the character, quality, cost, or quantity of 
15    material already used or to be used;
16        (2) the quality or quantity of any work already

1    performed or to be performed; and
2        (3) any other related costs.
3    (b) Any violation of subsection (a) of this Section shall 
4render any contract to which the falsification, distortion, or 
5misrepresentations is related void as a matter of law, and the 
6Department shall rebid all affected projects.".
