AMENDMENT TO SENATE BILL 2532

2    AMENDMENT NO. ______. Amend Senate Bill 2532 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Military Veterans Assistance Act is amended
5by changing Section 9 as follows:
 
6    (330 ILCS 45/9)  (from Ch. 23, par. 3089)
7    Sec. 9. Veterans Assistance Commission.
8    (a) In counties having 2 or more posts, camps, chapters or
9detachments of military veterans organizations as may be
10recognized by law, a central assistance committee may be
11organized to be known as the Veterans Assistance Commission of
12such county, composed of delegates one delegate and alternates
13one alternate from a majority each of such posts, camps, units,
14and chapters or ship selected annually as determined by each
15post, ship, camp, or chapter. When so organized a commission
16shall be clothed with all the powers and charged with all the

1duties theretofore devolving upon the different posts and
2chapters as provided in Section 2.
3        (1) Beginning on January 1, 2017, and every January 1
4    thereafter, all Veterans Assistance Commissions shall
5    publish a notice to each post, camp, unit, chapter, ship,
6    or detachment of a military veterans organization within
7    their respective county calling on them to select delegates
8    and alternates for that county's Veterans Assistance
9    Commission by the methods provided in this subsection. The
10    Veterans Assistance Commissions shall allow each post,
11    camp, unit, chapter, ship, or detachment of a military
12    veterans organization 60 days to respond.
13        (2) Except as provided in paragraph (3), posts, camps,
14    units, chapters, ships, or detachments of a military
15    veterans organization shall be permitted to select one
16    delegate and one alternate.
17        (3) In counties with 5 or more posts, camps, units,
18    chapters, ships, or detachments of the same military
19    veterans organization, all the constituent posts, camps,
20    units, chapters, ships, or detachments of such military
21    organizations shall be permitted to select a single
22    delegate and single alternate to represent that military
23    veterans organization instead of each constituent post,
24    camp, unit, chapter, ship, or detachment selecting one
25    delegate and one alternate. For the purposes of meeting the
26    majority requirement of this subsection, when the

1    constituent groups of a military veterans organization
2    choose to select a single delegate and single alternate,
3    the single delegate and single alternate shall represent
4    the aggregate percentage of the constituent groups.
5    (b) The Commission superintendent and the president or
6chairman of the county board, or some other county officer
7appointed by him, shall have general oversight of the
8distribution of all moneys and supplies appropriated by the
9county for the benefit of military veterans and their families,
10subject to such rules, regulations, administrative procedures
11or audit reviews as are necessary as approved by the county
12board to carry out the spirit and intent of this Act. No
13warrant authorized under this Act may be issued for the payment
14of money without the presentation of an itemized statement or
15claim, approved by the superintendent of the Commission.
16    If general assistance funds are allocated to a county for
17assistance to military veterans and their families as provided
18in the Illinois Public Aid Code, the administration of such
19funds and of county tax funds levied for such purpose as
20provided in Section 5-2006 of the Counties Code shall be
21subject to the supervision of the Department of Human Services
22in accordance with the provisions of the Illinois Public Aid
23Code. The superintendent of the Veterans Assistance Commission
24must comply with the procedures and regulations adopted by the
25Veterans Assistance Commission and the regulations of the
26Department of Human Services. To further the intent of this Act

1of assisting military veterans, this Act is to be construed so
2that the Veterans Assistance Commission shall provide needed
3services to eligible veterans.
