AMENDMENT TO SENATE BILL 2393

2    AMENDMENT NO. ______. Amend Senate Bill 2393 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Childhood Hunger Relief Act is amended by
5adding Section 16 as follows:
 
6    (105 ILCS 126/16 new)
7    Sec. 16. Breakfast after the bell program.
8    (a) The board of education of each school district in this
9State shall implement and operate a breakfast after the bell
10program in the next academic year after the effective date of
11this amendatory Act of the 99th General Assembly, if a
12breakfast after the bell program does not currently exist, in
13accordance with federal guidelines in each school building
14within its district (1) in which at least 70% or more of the
15students are eligible for free or reduced-price lunches based
16upon the current year's October claim (for those schools that

1participate in the National School Lunch Program); (2) in which
2at least 70% or more of the students are classified as
3low-income according to the Fall Housing Data from the previous
4year (for those schools that do not participate in the National
5School Lunch Program); or (3) that has a claiming percentage
6for free or reduced-price meals of 70% or more (for those
7schools using Provision 2 under Section 11(a)(1) of the federal
8Richard B. Russell National School Lunch Act or the Community
9Eligibility Provision under Section 104(a) of the federal
10Healthy, Hunger-Free Kids Act of 2010 to provide universal
11meals). If a school falls below the applicable 70% threshold
12for 2 consecutive years, it has the option to continue
13participating in the program, but is not required to do so.
14    (b) Each school under this Section may determine the
15breakfast after the bell service model that best suits its
16students. Service models include, but are not limited to,
17breakfast in the classroom, grab and go breakfast, and
18second-chance breakfast.
19    (c) Before the beginning of the next academic year after
20the effective date of this amendatory Act of the 99th General
21Assembly, the State Board of Education shall develop and
22distribute procedures and guidelines for the implementation of
23this Section, which must be in compliance with federal
24regulations governing the school breakfast program.
25    (d) The State Board of Education shall annually collect
26information about breakfast after the bell delivery models

1implemented at each school and make the information publicly
2available.
3    (e) In fulfilling its responsibilities under this Section,
4the State Board of Education shall collaborate with nonprofit
5organizations knowledgeable about equity, the opportunity gap,
6hunger and food security issues, and best practices for
7improving student access to school breakfast. The State Board
8of Education shall maintain a list of opportunities for
9philanthropic support of school breakfast programs and make the
10list available to schools interested in a breakfast after the
11bell program.".
