1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The State Mandates Act is amended by changing |
5 | | Section 7 as follows:
|

7 | | Sec. 7. Review of Existing Mandates. |
8 | | (a) Beginning with the 2019 catalog and every other year |
9 | | thereafter, concurrently Concurrently with, or within
3 months |
10 | | subsequent to the publication of a catalog of State mandates as
|
11 | | prescribed in subsection (b) of Section 4 the Department shall |
12 | | submit to
the Governor and the General Assembly a review and |
13 | | report on mandates enacted in the previous 2 years
prior to the |
14 | | effective date of this Act and remaining in effect at the time |
15 | | of submittal
of the report. The Department may fulfill its |
16 | | responsibilities for compiling the report by entering into a |
17 | | contract for service.

18 | | Beginning with the 2017 catalog and every 10 years |
19 | | thereafter, concurrently with, or within 3 months subsequent to |
20 | | the publication of a catalog of State mandates as prescribed in |
21 | | subsection (b) of Section 4, the Department shall submit to the |
22 | | Governor and the General Assembly a review and report on all |
23 | | effective mandates at the time of submittal of the reports. |

1 | | (b) The report shall include for each mandate the |
2 | | following: (1) The factual
information specified in subsection |
3 | | (b) of Section 4 for the catalog . ; The report may also include |
4 | | the following: (1) (2)
extent to which the enactment of the |
5 | | mandate was requested, supported, encouraged
or opposed by |
6 | | local governments or their respective organization;
(2) (3) |
7 | | whether the mandate continues to meet a Statewide policy |
8 | | objective or
has achieved the initial policy intent in whole or |
9 | | in part; (3) (4) amendments
if any are required to make the |
10 | | mandate more effective; (4) (5) whether the mandate
should be |
11 | | retained or rescinded; (5) (6) whether State financial |
12 | | participation
in helping meet the identifiable increased local |
13 | | costs arising from the
mandate should be initiated, and if so, |
14 | | recommended ratios and phasing-in
schedules; and (6) (7) any |
15 | | other information or recommendations which the
Department |
16 | | considers pertinent ; and (7) any comments about the mandate |
17 | | submitted by affected units of government .

18 | | (c) The appropriate committee of each house of the General |
19 | | Assembly shall
review the report and shall initiate such |
20 | | legislation or other action as
it deems necessary.
|
21 | | The requirement for reporting to the General Assembly shall |
22 | | be satisfied
by filing copies of the report with the Speaker, |
23 | | the Minority Leader and
the Clerk of the House of |
24 | | Representatives and the President, the Minority
Leader, the |
25 | | Secretary of the Senate, the members of the committees required

26 | | to review the report under subsection (c) and the Legislative |

3 | | 25, 1874, as amended, and filing such
additional copies with |
4 | | the State Government Report Distribution Center for

5 | | Assembly as is required under paragraph (t) of Section 7 of
the |
6 | | State Library Act.
