Amends the Illinois Vehicle Code. Requires low-speed vehicles to meet certain minimum equipment requirements for street operation. Provides that owners of low-speed vehicles that may be operated upon a highway shall secure a certificate of title and display valid registration.

1 | | AN ACT concerning transportation.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by changing |
5 | | Section 11-1426.2 as follows: |
6 | | (625 ILCS 5/11-1426.2) |
7 | | Sec. 11-1426.2. Operation of low-speed vehicles on |
8 | | streets. |
9 | | (a) Except as otherwise provided in this Section, it is |
10 | | lawful for any person to drive or operate a low-speed vehicle |
11 | | upon any street in this State where the posted speed limit is |
12 | | 30 miles per hour or less. |
13 | | (b) Low-speed vehicles may cross a street at an |
14 | | intersection where the street being crossed has a posted speed |
15 | | limit of not more than 45 miles per hour. Low-speed vehicles |
16 | | may not cross a street with a speed limit in excess of 45 miles |
17 | | per hour unless the crossing is at an intersection controlled |
18 | | by a traffic light or 4-way stop sign. |
19 | | (c) The Department of Transportation or a municipality, |
20 | | township, county, or other unit of local government may |
21 | | prohibit, by regulation, ordinance, or resolution, the |
22 | | operation of low-speed vehicles on streets under its |
23 | | jurisdiction where the posted speed limit is 30 miles per hour |

1 | | or less if the Department of Transportation or unit of local |
2 | | government determines that the public safety would be |
3 | | jeopardized. |
4 | | (d) Upon determining that low-speed vehicles may not safely |
5 | | operate on a street, and upon the adoption of an ordinance or |
6 | | resolution by a unit of local government, or regulation by the |
7 | | Department of Transportation, the operation of low-speed |
8 | | vehicles may be prohibited. The unit of local government or the |
9 | | Department of Transportation may prohibit the operation of |
10 | | low-speed vehicles on any and all streets under its |
11 | | jurisdiction. Appropriate signs shall be posted in conformance |
12 | | with the State Manual on Uniform Traffic Control Devices |
13 | | adopted pursuant to Section 11-301 of this Code. |
14 | | (e) If a street is under the jurisdiction of more than one |
15 | | unit of local government, or under the jurisdiction of the |
16 | | Department of Transportation and one or more units of local |
17 | | government, low-speed vehicles may be operated on the street |
18 | | unless each unit of local government and the Department of |
19 | | Transportation agree and take action to prohibit such operation |
20 | | as provided in this Section. |
21 | | (e-5) A unit of local government may, by ordinance or |
22 | | resolution, authorize the operation of low-speed vehicles on |
23 | | one or more streets under its jurisdiction that have a speed |
24 | | limit of more than 30 miles per hour but not greater than 35 |
25 | | miles per hour. |
26 | | Before authorizing the operation of low-speed vehicles on |

1 | | any street under this subsection (e-5), the unit of local |
2 | | government must consider the volume, speed, and character of |
3 | | traffic on the street and determine whether low-speed vehicles |
4 | | may travel safely on that street. |
5 | | If a street is under the jurisdiction of more than one unit |
6 | | of government, low-speed vehicles may not be operated on the |
7 | | street under this subsection (e-5) unless each unit of |
8 | | government agrees and takes action as provided in this |
9 | | subsection. |
10 | | Upon the adoption of an ordinance authorizing low-speed |
11 | | vehicles under this subsection (e-5), appropriate signs shall |
12 | | be posted. |
13 | | (f) No low-speed vehicle may be operated on any street |
14 | | unless, at a minimum, it has the following: a parking brake |
15 | | brakes , a steering apparatus, tires, a windshield that conforms |
16 | | to the federal vehicle safety standards on glazing materials as |
17 | | set forth in 49 CFR part 571.205, a vehicle identification |
18 | | number, seat belts, a rearview mirror, an exterior rearview |
19 | | mirror mounted on the driver's side of the vehicle, red |
20 | | reflectorized warning devices on each rear side and one on the |
21 | | center rear of the vehicle in the front and rear , a headlight |
22 | | that emits a white light visible from a distance of 500 feet to |
23 | | the front, a tail lamp that emits a red light visible from at |
24 | | least 100 feet from the rear, brake lights, and front and rear |
25 | | turn signals. When operated on a street, a low-speed vehicle |
26 | | shall have its headlight and tail lamps lighted as required by |

1 | | Section 12-201 of this Code. |
2 | | (g) A person may not operate a low-speed vehicle upon any |
3 | | street in this State unless he or she has a valid driver's |
4 | | license issued in his or her name by the Secretary of State or |
5 | | a foreign jurisdiction. |
6 | | (h) The operation of a low-speed vehicle upon any street is |
7 | | subject to the provisions of Chapter 11 of this Code concerning |
8 | | the Rules of the Road, and applicable local ordinances. |
9 | | (i) Every owner of a low-speed vehicle is subject to the |
10 | | mandatory insurance requirements specified in Article VI of |
11 | | Chapter 7 of this Code. |
12 | | (j) Any person engaged in the retail sale of low-speed |
13 | | vehicles are required to comply with the motor vehicle dealer |
14 | | licensing, registration, and bonding laws of this State, as |
15 | | specified in Sections 5-101 and 5-102 of this Code. |
16 | | (k) No action taken by a unit of local government under |
17 | | this Section designates the operation of a low-speed vehicle as |
18 | | an intended or permitted use of property with respect to |
19 | | Section 3-102 of the Local Governmental and Governmental |
20 | | Employees Tort Immunity Act. |
21 | | (l) Every owner of a low-speed vehicle which may be |
22 | | operated upon a highway shall secure a certificate of title and |
23 | | display valid registration. |
