Amends the State Finance Act. Creates the Benevolent and Protective Order of Elks Scholarship Fund as a special fund in the State treasury. Amends the Illinois Vehicle Code to provide for the issuance of Benevolent and Protective Order of Elks plates. Provides that the applicant shall pay an additional fee of $25 for original issuance of the plates, of which $10 shall be deposited into the Benevolent and Protective Order of Elks Scholarship Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund. Provides that an additional fee of $25 shall be charged for each renewal, of which $23 shall be deposited into the Benevolent and Protective Order of Elks Scholarship Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund. Provides that money in the Benevolent and Protective Order of Elks Scholarship Fund shall be paid as grants for scholarships for higher education. Provides that the scholarship recipients must be the children of current or former members of the Benevolent and Protective Order of Elks who meet the academic, financial, and other requirements established by the Benevolent and Protective Order of Elks. Requires that the recipients of the scholarship be residents of this State and attend a college or university located within this State.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The State Finance Act is amended by adding |
5 | | Section 5.866 as follows: |

9 | | Section 10. The Illinois Vehicle Code is amended by adding |
10 | | Section 3-699.14 as follows: |

14 | | (a) The Secretary, upon receipt of all applicable fees and |
15 | | applications made in the form prescribed by the Secretary of

16 | | State, may issue special registration plates designated as |
17 | | Benevolent and Protective Order of Elks plates. The special |
18 | | plates issued under this Section shall be affixed only to |
19 | | passenger vehicles of the first division or motor vehicles of |
20 | | the second division weighing not more than 8,000 lbs. Plates |
21 | | issued under this Section shall expire according to the |

1 | | multi-year procedure established by Section 3-414.1 of this |
2 | | Code. |
3 | | (b) The design and color of the special plates shall be |
4 | | wholly within the discretion of the Secretary. The Secretary |
5 | | may allow the plates to be issued as vanity plates or |
6 | | personalized plates under Section 3-405.1 of the Code. |
7 | | Appropriate documentation, as determined by the Secretary, |
8 | | shall accompany each application. |
9 | | (c) An applicant shall be charged a $25 fee for original |
10 | | issuance in addition to the appropriate registration fee, if |
11 | | applicable. Of this fee, $10 shall be deposited into the |
12 | | Benevolent and Protective Order of Elks Scholarship Fund and |
13 | | $15 shall be deposited into the Secretary of State Special |
14 | | License Plate Fund. For each registration renewal period, a $25 |
15 | | fee, in addition to the appropriate registration fee, shall be |
16 | | charged. Of this fee, $23 shall be deposited into the |
17 | | Benevolent and Protective Order of Elks Scholarship Fund and $2 |
18 | | shall be deposited into the Secretary of State Special License |
19 | | Plate Fund. |
20 | | (d) The Benevolent and Protective Order of Elks Scholarship |
21 | | Fund is created as a special fund in the State treasury. All |
22 | | moneys in the Benevolent and Protective Order of Elks |
23 | | Scholarship Fund shall be paid, subject to appropriation by the |
24 | | General Assembly and distribution by the Secretary, as grants |
25 | | for scholarships for higher education. The scholarship |
26 | | recipients must be the children of current or former members of |
