1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Sections 2310-676 and 2310-677 as follows:
 
7    (20 ILCS 2310/2310-676 new)
8    Sec. 2310-676. Advisory council on pediatric autoimmune
9neuropsychiatric disorder associated with streptococcal
10infections and pediatric acute neuropsychiatric syndrome.
11    (a) There is established an advisory council on pediatric
12autoimmune neuropsychiatric disorder associated with
13streptococcal infections and pediatric acute neuropsychiatric
14syndrome to advise the Director of Public Health on research,
15diagnosis, treatment, and education relating to the disorder
16and syndrome.
17    (b) The advisory council shall consist of the following
18members, who shall be appointed by the Director of Public
19Health within 60 days after the effective date of this
20amendatory Act of the 99th General Assembly:
21        (1) An immunologist licensed and practicing in this
22    State who has experience treating persons with pediatric
23    autoimmune neuropsychiatric disorder associated with

1    streptococcal infections and pediatric acute
2    neuropsychiatric syndrome and the use of intravenous
3    immunoglobulin.
4        (2) A health care provider licensed and practicing in
5    this State who has expertise in treating persons with
6    pediatric autoimmune neuropsychiatric disorder associated
7    with streptococcal infections and pediatric acute
8    neuropsychiatric syndrome and autism.
9        (3) A representative of PANDAS/PANS Advocacy &
10    Support.
11        (4) An osteopathic physician licensed and practicing
12    in this State who has experience treating persons with
13    pediatric autoimmune neuropsychiatric disorder associated
14    with streptococcal infections and pediatric acute
15    neuropsychiatric syndrome.
16        (5) A medical researcher with experience conducting
17    research concerning pediatric autoimmune neuropsychiatric
18    disorder associated with streptococcal infections,
19    pediatric acute neuropsychiatric syndrome,
20    obsessive-compulsive disorder, tic disorder, and other
21    neurological disorders.
22        (6) A certified dietitian-nutritionist practicing in
23    this State who provides services to children with autism
24    spectrum disorder, attention-deficit hyperactivity
25    disorder, and other neuro-developmental conditions.
26        (7) A representative of a professional organization in

1    this State for school psychologists.
2        (8) A child psychiatrist who has experience treating
3    persons with pediatric autoimmune neuropsychiatric
4    disorder associated with streptococcal infections and
5    pediatric acute neuropsychiatric syndrome.
6        (9) A representative of a professional organization in
7    this State for school nurses.
8        (10) A pediatrician who has experience treating
9    persons with pediatric autoimmune neuropsychiatric
10    disorder associated with streptococcal infections and
11    pediatric acute neuropsychiatric syndrome.
12        (11) A representative of an organization focused on
13    autism.
14        (12) A parent with a child who has been diagnosed with
15    pediatric autoimmune neuropsychiatric disorder associated
16    with streptococcal infections or pediatric acute
17    neuropsychiatric syndrome and autism.
18        (13) A social worker licensed and practicing in this
19    State.
20        (14) A representative of the Special Education
21    Services division of the State Board of Education.
22        (15) One member of the General Assembly appointed by
23    the Speaker of the House of Representatives.
24        (16) One member of the General Assembly appointed by
25    the President of the Senate.
26        (17) One member of the General Assembly appointed by

1    the Minority Leader of the House of Representatives.
2        (18) One member of the General Assembly appointed by
3    the Minority Leader of the Senate.
4    (c) The Director of Public Health, or his or her designee,
5shall be an ex-officio, nonvoting member and shall attend all
6meetings of the advisory council. Any member of the advisory
7council appointed under this Section may be a member General
8Assembly. Members shall receive no compensation for their
9services.
10    (d) The Director of Public Health shall schedule the first
11meeting of the advisory council, which shall be held not later
12than 90 days after the effective date of this amendatory Act of
13the 99th General Assembly. A majority of the council members
14shall constitute a quorum. A majority vote of a quorum shall be
15required for any official action of the advisory council. The
16advisory council shall meet upon the call of the chairperson or
17upon the request of a majority of council members.
18    (e) Not later than January 1, 2017, and annually
19thereafter, the advisory council shall issue a report to the
20General Assembly with recommendations concerning:
21        (1) practice guidelines for the diagnosis and
22    treatment of the disorder and syndrome;
23        (2) mechanisms to increase clinical awareness and
24    education regarding the disorder and syndrome among
25    physicians, including pediatricians, school-based health
26    centers, and providers of mental health services;

1        (3) outreach to educators and parents to increase
2    awareness of the disorder and syndrome; and
3        (4) development of a network of volunteer experts on
4    the diagnosis and treatment of the disorder and syndrome to
5    assist in education and outreach.
 
6    (20 ILCS 2310/2310-677 new)
7    Sec. 2310-677. Neonatal Abstinence Syndrome Advisory
8Committee.
9    (a) As used in this Section:
10    "Department" means the Department of Public Health.
11    "Director" means the Director of Public Health.
12    "Neonatal Abstinence Syndrome" or "NAS" means various
13adverse conditions that occur in a newborn infant who was
14exposed to addictive or prescription drugs while in the
15mother's womb.
16    (b) There is created the Advisory Committee on Neonatal
17Abstinence Syndrome. The Advisory Committee shall consist of up
18to 10 members appointed by the Director of Public Health. The
19Director shall make the appointments within 90 days after the
20effective date of this amendatory Act of the 99th General
21Assembly. Members shall receive no compensation for their
22services. The members of the Advisory Committee shall represent
23different racial, ethnic, and geographic backgrounds and
24consist of:
25        (1) at least one member representing a statewide

1    association of hospitals;
2        (2) at least one member representing a statewide
3    organization of pediatricians;
4        (3) at least one member representing a statewide
5    organization of obstetricians;
6        (4) at least one member representing a statewide
7    organization that advocates for the health of mothers and
8    infants;
9        (5) at least one member representing a statewide
10    organization of licensed physicians;
11        (6) at least one member who is a licensed practical
12    nurse, registered professional nurse, or advanced practice
13    nurse with expertise in the treatment of newborns in
14    neonatal intensive care units;
15        (7) at least one member representing a local or
16    regional public health agency; and
17        (8) at least one member with expertise in the treatment
18    of drug dependency and addiction.
19    (c) In addition to the membership in subsection (a) of this
20Section, the following persons or their designees shall serve
21as ex officio members of the Advisory Committee: the Director
22of Public Health, the Secretary of Human Services, the Director
23of Healthcare and Family Services, and the Director of Children
24and Family Services. The Director of Public Health, or his or
25her designee, shall serve as Chair of the Committee.
26    (d) The Advisory Committee shall meet at the call of the

1Chair. The Committee shall meet at least 3 times each year and
2its initial meeting shall take place within 120 days after the
3effective date of this Act. The Advisory Committee shall advise
4and assist the Department to:
5        (1) develop an appropriate standard clinical
6    definition of "NAS";
7        (2) develop a uniform process of identifying NAS;
8        (3) develop protocols for training hospital personnel
9    in implementing an appropriate and uniform process for
10    identifying and treating NAS;
11        (4) identify and develop options for reporting NAS data
12    to the Department by using existing or new data reporting
13    options; and
14        (5) make recommendations to the Department on
15    evidence-based guidelines and programs to improve the
16    outcomes of pregnancies with respect to NAS.
17    (e) The Advisory Committee shall provide an annual report
18of its activities and recommendations to the Director, the
19General Assembly, and the Governor by March 31 of each year
20beginning in 2016. The final report of the Advisory Committee
21shall be submitted by March 31, 2019.
22    (f) This Section is repealed on June 30, 2019.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
