Amends the Fire Protection District Act. Provides that the Board of Trustees of any fire protection district incorporated under this Act that is wholly located outside the counties of Cook, DuPage, Lake, Kane, McHenry, and Will, may declare abandoned structures located within the fire protection district as a public nuisance when the abandoned structure is a blighted structure. Provides that abandoned structures that are declared a public nuisance may be used by the fire protection district for firefighting training exercises and that the fire protection district shall not be liable for persons injured in any structure used for firefighting training exercises. Further provides that the abandoned structure shall be properly disposed of within 1 year of having been declared a public nuisance, regardless of whether or not it has yet been used for fire training purposes. Defines "blighted structure".

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Fire Protection District Act is amended by |
5 | | changing Section 10 as follows:
|
6 | | (70 ILCS 705/10) (from Ch. 127 1/2, par. 30)

7 | | Sec. 10. Acquisition of private property; abandoned |
8 | | structures. |
9 | | (a) The Board of Trustees of any fire protection district |
10 | | incorporated
under this Act has the power to acquire private |
11 | | property by gift, grant,
lease, purchase, condemnation or |
12 | | otherwise, within the boundaries of said
district, or within |
13 | | one mile beyond the boundaries of said district, for
the |
14 | | purposes herein specified and to adopt and enforce ordinances |
15 | | for the
necessary protection of sources of the water supply and |
16 | | also has power to
build houses for care of fire protection |
17 | | apparatus. When private property
is condemned under this Act, |
18 | | the compensation shall be determined in the
manner
as provided |
19 | | for the exercise of the right of
eminent domain under the |
20 | | Eminent Domain Act.
