SYNOPSIS AS INTRODUCED:
 
70 ILCS 705/10  from Ch. 127 1/2, par. 30

    Amends the Fire Protection District Act. Provides that the Board of Trustees of any fire protection district incorporated under this Act that is wholly located outside the counties of Cook, DuPage, Lake, Kane, McHenry, and Will, may declare abandoned structures located within the fire protection district as a public nuisance when the abandoned structure is a blighted structure. Provides that abandoned structures that are declared a public nuisance may be used by the fire protection district for firefighting training exercises and that the fire protection district shall not be liable for persons injured in any structure used for firefighting training exercises. Further provides that the abandoned structure shall be properly disposed of within 1 year of having been declared a public nuisance, regardless of whether or not it has yet been used for fire training purposes. Defines "blighted structure".

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fire Protection District Act is amended by
5changing Section 10 as follows:
 
6    (70 ILCS 705/10)  (from Ch. 127 1/2, par. 30)
7    Sec. 10. Acquisition of private property; abandoned
8structures.
9    (a) The Board of Trustees of any fire protection district
10incorporated under this Act has the power to acquire private
11property by gift, grant, lease, purchase, condemnation or
12otherwise, within the boundaries of said district, or within
13one mile beyond the boundaries of said district, for the
14purposes herein specified and to adopt and enforce ordinances
15for the necessary protection of sources of the water supply and
16also has power to build houses for care of fire protection
17apparatus. When private property is condemned under this Act,
18the compensation shall be determined in the manner as provided
19for the exercise of the right of eminent domain under the
20Eminent Domain Act.
21    (b) The Board of Trustees of any fire protection district
22incorporated under this Act that is wholly located outside the
23counties of Cook, DuPage, Lake, Kane, McHenry, and Will, may

1declare abandoned structures located within the fire
2protection district as a public nuisance when the abandoned
3structure is a blighted structure. Such abandoned structures
4declared a public nuisance may be used by the fire protection
5district for firefighting training exercises. The fire
6protection district shall not be liable for persons injured in
7any structure used for firefighting training exercises. Any
8such abandoned structures shall be properly disposed of within
91 year of having been declared a public nuisance, regardless of
10whether or not it has yet been used for fire training purposes.
11    (c) For purposes of this Section, "blighted structure"
12means a structure that has unsanitary or unsafe conditions; has
13deterioration of structural improvements; has the existence of
14conditions which endanger life or property by fire or other
15causes; or is a menace to the public health, safety, morals, or
16welfare; or any combination of these factors.
