SYNOPSIS AS INTRODUCED:
 
15 ILCS 5/1  from Ch. 127, par. 63b122

    If and only if Senate Joint Resolution Constitutional Amendment 7 of the 99th General Assembly is adopted, amends the Governor Succession Act to: (1) eliminate the reference to the office of Lieutenant Governor, and (2) require the successor to be of the same political party as the Governor. Adds the Minority Leader of the Senate to the list of successors.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. If and only if Senate Joint Resolution
5Constitutional Amendment 7 of the 99th General Assembly is
6adopted in accordance with Section 7 of the Illinois
7Constitutional Amendment Act, the Governor Succession Act is
8amended by changing Section 1 as follows:
 
9    (15 ILCS 5/1)  (from Ch. 127, par. 63b122)
10    Sec. 1. (a) In the event that the Governor, for any of the
11reasons specified in Article V, Section 6 of the Constitution
12of the State of Illinois, is not able to exercise the powers
13and discharge the duties of his office, such powers and duties
14of the office shall be exercised by the officer next in line of
15succession, in the order named as follows:
16        (1) (Blank) The Lieutenant Governor;
17        (2) The elected Attorney General, provided that the
18    Attorney General is of the same political party as the
19    Governor;
20        (3) The elected Secretary of State, provided that the
21    Secretary of State is of the same political party as the
22    Governor;
23        (4) The elected Comptroller, provided that the

1    Comptroller is of the same political party as the Governor;
2        (5) The elected Treasurer, provided that the Treasurer
3    is of the same political party as the Governor;
4        (6) The President of the Senate, provided that the
5    President of the Senate is of the same political party as
6    the Governor;
7        (7) The Speaker of the House of Representatives,
8    provided that the Speaker of the House of Representatives
9    is of the same political party as the Governor; .
10        (8) The Minority Leader of the Senate, provided that
11    the Minority Leader of the Senate is of the same political
12    party as the Governor.
13    (b) The officer next in line of succession shall serve as
14Governor for the remainder of the term if he succeeds to the
15office by reason of death, conviction on impeachment or
16resignation of the Governor. If he succeeds to the office by
17reason of temporary disability or failure to qualify by the
18Governor, he shall serve until the Governor qualifies or the
19disability is removed. An officer who succeeds to the office of
20Governor by reason of temporary disability of the Governor
21shall be designated Acting Governor.
22    (c) If an officer next in line of succession shall fail to
23qualify or if his office is vacant, then the officer next in
24line of succession after him who is qualified shall serve as
25Governor.
