1 | | AN ACT concerning regulation.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the Music |
5 | | Therapy Advisory Board Act. |
6 | | Section 5. Definitions. As used in this Act: |
7 | | "Board" means the Music Therapy Advisory Board. |
8 | | "Music therapist" means a person who is certified by the |
9 | | Certification Board for Music Therapists. |
10 | | "Music therapy" means the clinical and evidence-based use |
11 | | of music interventions to accomplish individualized goals for |
12 | | people of all ages and ability levels within a therapeutic |
13 | | relationship by a credentialed professional who has completed |
14 | | an approved music therapy program. The music therapy |
15 | | interventions may include music improvisation, receptive music |
16 | | listening, song writing, lyric discussion, music and imagery, |
17 | | singing, music performance, learning through music, music |
18 | | combined with other arts, music-assisted relaxation, |
19 | | music-based patient education, electronic music technology, |
20 | | adapted music intervention, and movement to music. The term |
21 | | "music therapy" does not include the diagnosis or assessment of |
22 | | any physical, mental, or communication disorder. |
23 | | "Department" means the Department of Financial and |

1 | | Professional Regulation. |
2 | | "Secretary" means the Secretary of Financial and |
3 | | Professional Regulation or his or her designee. |
4 | | Section 10. Advisory board. |
5 | | (a) There is created the Music Therapy Advisory Board |
6 | | within the Department. The Board shall consist of 7 members |
7 | | appointed by the Secretary for a term of 2 years. The Secretary |
8 | | shall make the appointments to the Board within 90 days after |
9 | | the effective date of this Act. The members of the Board shall |
10 | | represent different racial and ethnic backgrounds, reasonably |
11 | | reflect the different geographic areas in Illinois, and have |
12 | | the qualifications as follows: |
13 | | (1) three members who currently serve as music |
14 | | therapists in Illinois; |
15 | | (2) one member who represents the Department; |
16 | | (3) one member who is a licensed psychologist or |
17 | | professional counselor in Illinois; |
18 | | (4) one member who is a licensed social worker in |
19 | | Illinois; and |
20 | | (5) one representative of a community college, |
21 | | university, or educational institution that provides |
22 | | training to music therapists.

23 | | (b) The members of the Board shall select a chairperson |
24 | | from the members of the Board. The Board shall consult with |
25 | | additional experts as needed. Four members constitute a quorum. |

1 | | The Board shall hold its first meeting within 30 days after the |
2 | | appointment of members by the Secretary. Members of the Board |
3 | | shall serve without compensation. The Department shall provide |
4 | | administrative and staff support to the Board. The meetings of |
5 | | the Board are subject to the provisions of the Open Meetings |
6 | | Act. |
7 | | (c) The Board shall consider the core competencies of a |
8 | | music therapist, including skills and areas of knowledge that |
9 | | are essential to bringing about music therapy services to |
10 | | communities by qualified individuals. As relating to music |
11 | | therapy services, the core competencies for effective music |
12 | | therapists may include, but are not limited to:

13 | | (1) materials to educate the public concerning music |
14 | | therapist licensure; |
15 | | (2) the benefits of music therapy; |
16 | | (3) the utilization of music therapy by individuals and |
17 | | in facilities or institutional settings; |
18 | | (4) culturally competent communication and care; |
19 | | (5) music therapy for behavior change; |
20 | | (6) support from the American Music Therapy |
21 | | Association or any successor organization and the |
22 | | Certification Board for Music Therapists; |
23 | | (7) clinical training; and |
24 | | (8) education and continuing education requirements. |
25 | | Section 15. Report. |

1 | | (a) The Board shall develop a report with its |
2 | | recommendations regarding the certification process for music |
3 | | therapists. The report shall be completed no later than 12 |
4 | | months after the first meeting of the Board. The report shall |
5 | | be submitted to all members of the Board, the Secretary, the |
6 | | Governor, the President of the Senate, the Minority Leader of |
7 | | the Senate, the Speaker of the House of Representatives, and |
8 | | the Minority Leader of the House of Representatives. The |
9 | | Department shall publish the report on its Internet website. |
10 | | (b) The report shall at a minimum include the following: |
11 | | (1) a summary of research regarding the best practices, |
12 | | curriculum, and training programs for designing a |
13 | | certification program in this State for music therapists, |
14 | | including a consideration of a multi-tiered education or |
15 | | training system, statewide certification, |
16 | | non-certification degree-based levels of certification, |
17 | | support from the American Music Therapy Association and |
18 | | Certification Board for Music Therapists, and the |
19 | | requirements for experience-based certification; |
20 | | (2) recommendations regarding certification and |
21 | | renewal process for music therapists and a system of |
22 | | approval and accreditation for curriculum and training; |
23 | | (3) recommendations for a proposed curriculum for |
24 | | music therapists that ensures the content, methodology, |
25 | | development, and delivery of any proposed program is |
26 | | appropriately based on cultural, geographic, and other |

1 | | specialty needs and also reflects relevant |
2 | | responsibilities for music therapists; and |
3 | | (4) recommendations for best practices for |
4 | | reimbursement options and pathways through which secure |
5 | | funding for music therapists may be obtained. |
6 | | (c) The Board shall advise the Department, the Governor, |
7 | | and the General Assembly on all matters that impact the |
8 | | effective work of music therapists.
