SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/4-604 new

    Amends the Public Utilities Act. Requires the Illinois Commerce Commission to update its response presented in the report titled "Potential Nuclear Power Plant Closings in Illinois". Also requires the Commission to update, in conjunction with the Illinois Power Agency, the Illinois Environmental Protection Agency, and the Department of Commerce and Economic Opportunity, the report's findings regarding potential market-based solutions that will ensure the premature closure of these nuclear power plants does not occur and that the dire consequence to the economy, jobs, and the environment are averted. Provides that the provision is repealed on June 30, 2017. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by adding
5Section 4-604 as follows:
 
6    (220 ILCS 5/4-604 new)
7    Sec. 4-604. Potential Nuclear Power Plant Closings in
8Illinois; updates. No later than June 30, 2016, the Commission
9shall update its response presented in the report titled
10"Potential Nuclear Power Plant Closings in Illinois", which was
11issued on January 5, 2015 in response to House Resolution 1146
12of the 98th General Assembly. Pursuant to the resolution, the
13Commission (i) examined the ability of the State and grid
14operators to expand transmission resources that might allow
15increased sales of electricity generated from low or zero
16carbon emitting facilities located within Illinois, as well as
17any legislative impediments related thereto, and (ii) studied
18the impact of Illinois nuclear plant closures upon residential,
19commercial, and industrial electric customers' rates. The
20Commission shall also update, in conjunction with the Illinois
21Power Agency, the Illinois Environmental Protection Agency,
22and the Department of Commerce and Economic Opportunity, the
23report's findings regarding potential market-based solutions

4    This Section is repealed on June 30, 2017.
 
5    Section 99. Effective date. This Act takes effect upon
6becoming law.
