Amends the Public Utilities Act. Requires the Illinois Commerce Commission to update its response presented in the report titled "Potential Nuclear Power Plant Closings in Illinois". Also requires the Commission to update, in conjunction with the Illinois Power Agency, the Illinois Environmental Protection Agency, and the Department of Commerce and Economic Opportunity, the report's findings regarding potential market-based solutions that will ensure the premature closure of these nuclear power plants does not occur and that the dire consequence to the economy, jobs, and the environment are averted. Provides that the provision is repealed on June 30, 2017. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Public Utilities Act is amended by adding |
5 | | Section 4-604 as follows: |

7 | | Sec. 4-604. Potential Nuclear Power Plant Closings in |
8 | | Illinois; updates. No later than June 30, 2016, the Commission |
9 | | shall update its response presented in the report titled |
10 | | "Potential Nuclear Power Plant Closings in Illinois", which was |
11 | | issued on January 5, 2015 in response to House Resolution 1146 |
12 | | of the 98th General Assembly. Pursuant to the resolution, the |
13 | | Commission (i) examined the ability of the State and grid |
14 | | operators to expand transmission resources that might allow |
15 | | increased sales of electricity generated from low or zero |
16 | | carbon emitting facilities located within Illinois, as well as |
17 | | any legislative impediments related thereto, and (ii) studied |
18 | | the impact of Illinois nuclear plant closures upon residential, |
19 | | commercial, and industrial electric customers' rates. The |
20 | | Commission shall also update, in conjunction with the Illinois |
21 | | Power Agency, the Illinois Environmental Protection Agency, |
22 | | and the Department of Commerce and Economic Opportunity, the |
23 | | report's findings regarding potential market-based solutions |
