1 | | AN ACT concerning education.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The School Code is amended by renumbering and |
5 | | changing Section 2-3.167, as added by Public Act 99-721, as |
6 | | follows: |
7 | | (105 ILCS 5/2-3.168) |
8 | | Sec. 2-3.168 2-3.167 . Advisory Council on At-Risk |
9 | | Students. |
10 | | (a) For purposes of this Section, "at-risk students" means |
11 | | students served by the
Department of Human Services who receive |
12 | | services through Medicaid, the
Supplemental Nutrition |
13 | | Assistance Program, the Children's Health Insurance Program,
|
14 | | or Temporary Assistance for Needy Families, as well as students |
15 | | under the legal
custody of the Department of Children and |
16 | | Family Services. Students may not be
counted more than once for |
17 | | receiving multiple services from the Department of Human
|
18 | | Services or if they receive those services and are under the |
19 | | legal custody of the
Department of Children and Family |
20 | | Services. |
21 | | (b) The Advisory Council on At-Risk Students is created |
22 | | within the State Board of
Education. The Advisory Council shall |
23 | | consist of all of the following members: |

1 | | (1) One member of the House of Representatives |
2 | | appointed by the Speaker of the House of Representatives. |
3 | | (2) One member of the House of Representatives |
4 | | appointed by the Minority Leader of the House of |
5 | | Representatives. |
6 | | (3) One member of the Senate appointed by the President |
7 | | of the Senate. |
8 | | (4) One member of the Senate appointed by the Minority |
9 | | Leader of the Senate. |
10 | | (5) The following members appointed by the State |
11 | | Superintendent of Education: |
12 | | (A) One member who is an educator representing a |
13 | | statewide
professional teachers' organization. |
14 | | (B) One member who is an educator representing a |
15 | | different statewide
professional teachers' |
16 | | organization. |
17 | | (C) One member who is an educator representing a |
18 | | professional
teachers' organization in a city having a |
19 | | population exceeding
500,000. |
20 | | (D) One member from an organization that works for |
21 | | economic,
educational, and social progress for African |
22 | | Americans and promotes
strong sustainable communities |
23 | | through advocacy, collaboration, and
innovation. |
24 | | (E) One member from an organization that |
25 | | facilitates the involvement of
Latino Americans at all |
26 | | levels of public decision-making. |

1 | | (F) One member from an organization focused on |
2 | | research-based
education policy to support a school |
3 | | system that prepares all students
for college, a |
4 | | career, and democratic citizenship. |
5 | | (G) One member from an organization dedicated to |
6 | | advocating for public
policies to prevent |
7 | | homelessness. |
8 | | (H) One member from the Illinois Student |
9 | | Assistance Commission. |
10 | | (I) One member from an organization that works to |
11 | | ensure the health
and safety of Illinois youth and |
12 | | families by providing capacity building
services. |
13 | | (J) One member from an organization that provides |
14 | | public high school
students with opportunities to |
15 | | explore and develop their talents, while
gaining |
16 | | critical skills for work, college, and beyond. |
17 | | (K) One member from an organization that promotes |
18 | | the strengths and
abilities of youth and families by |
19 | | providing community-based services
that empower each |
20 | | to face life's challenges with confidence,
competence, |
21 | | and dignity. |
22 | | (L) One member from an organization that connects |
23 | | former members of
the foster care system with current |
24 | | children in the foster care system. |
25 | | (M) One member who has experience with research and |
26 | | statistics. |

1 | | (N) Three members who are parents of at-risk |
2 | | students. |
3 | | (O) One member from an organization that optimizes |
4 | | the positive growth of at-risk youth and individuals |
5 | | working with at-risk youth through support services. |
6 | | (P) One member from a statewide organization |
7 | | representing regional superintendents offices of |
8 | | schools education . |
9 | | (Q) One member from an association representing |
10 | | school management. |
11 | | (R) One member from an organization representing |
12 | | principals in a city having a population exceeding |
13 | | 500,000. |
14 | | Members of the Council shall, to the extent possible, be |
15 | | selected on the basis of experience with or knowledge of |
16 | | various programs for at-risk students. The Council shall, to |
17 | | the extent possible, include diverse membership from a variety |
18 | | of socio-economic, racial, and
ethnic backgrounds. |
19 | | (c) Initial members of the Council shall serve terms |
20 | | determined by lot as follows: |
21 | | (1) Seven members shall serve for one year. |
22 | | (2) Seven members shall serve for 2 years. |
23 | | (3) The remaining members shall serve for 3 years. |
24 | | However, upon the appointment of the additional members under |
25 | | this amendatory Act of the 99th General Assembly, terms for the |
26 | | initial members of the Council shall be redetermined, with the |

1 | | initial and additional members of the Council serving as |
2 | | follows: |
3 | | (A) Members appointed under subdivisions (1) through |
4 | | (4) of subsection (b) of this Section shall serve on the |
5 | | Council until their successors are appointed. |
6 | | (B) Of the members appointed under subdivision (5) of |
7 | | subsection (b) of this Section, 6 members shall serve for |
8 | | one year, 6 members shall serve for 2 years, and the |
9 | | remaining members shall serve for 3 years, as determined by |
10 | | lot. |
11 | | (c-5) Successors to members appointed under subdivisions |
12 | | (1) through (4) of subsection (b) of this Section shall serve |
13 | | on the Council until their successors are appointed. Successors |
14 | | to members appointed under subdivision (5) of subsection (b) of |
15 | | this Section shall serve 3-year terms and . Members must serve |
16 | | until their successors are appointed and have qualified . |
17 | | (d) Members of the Council shall serve without compensation |
18 | | but may be reimbursed for travel if funds are made available |
19 | | for that specific purpose not receive compensation for the |
20 | | performance of their duties on the Council . |
21 | | (e) The Council shall initially meet at the call of the |
22 | | State Superintendent of
Education. The At the initial meeting, |
23 | | members shall elect select a chairperson from among their

24 | | number at their initial meeting, with successor chairpersons |
25 | | being elected as determined by the Council by majority vote; a |
26 | | representative from the State Board of Education may cast a
|

1 | | deciding vote if there is a tie. The Council shall select a |
2 | | chairperson annually, who
may be the same chairperson as the |
3 | | year prior . Thereafter, the The Council shall meet at the
call |
4 | | of the chairperson after the initial meeting . |
5 | | (f) The State Board of Education and City of Chicago School |
6 | | District 299 shall provide administrative support to the |
7 | | Council. |
8 | | (g) The Council shall operate under the provisions of the |
9 | | Open Meetings Act and accept and consider public comments when |
10 | | making its
recommendations . |
11 | | (h) By no later than December 15, 2017, the Council shall |
12 | | submit a report to the State Board
Superintendent of Education, |
13 | | the Governor, and the General Assembly addressing, at a
|
14 | | minimum, the following with respect to school districts where |
15 | | racial minorities comprise a majority of the student |
16 | | population: |
17 | | (1) What are the barriers to success present for |
18 | | at-risk students? |
19 | | (2) How much does socio-economic status impact |
20 | | academic and career
achievement? |
21 | | (3) How do at-risk students perform academically? |
22 | | (4) How do at-risk students perform academically |
23 | | compared to students from
higher socio-economic statuses? |
24 | | (5) What programs are shown to help at-risk students |
25 | | reach higher levels of
academic and career achievement? |
26 | | (6) What specific curriculums help the academic |

|
1 | | success of at-risk students? |
2 | | (7) Of curriculums that help at-risk students, which of |
3 | | these need to be
implemented within the Illinois Learning |
4 | | Standards? |
5 | | (8) To what degree do school districts teach cultural |
6 | | history, and how can this be
improved? |
7 | | (9) Specific policy recommendations to improve the |
8 | | academic success of at-risk students. |
9 | | (10) Any other information that the Council determines |
10 | | will assist in the
understanding of the barriers to success |
11 | | for or increase the academic
performance of at-risk |
12 | | students. |
13 | | The Council shall submit an annual report regarding with |
14 | | updated information on the barriers to
academic success and the |
15 | | academic progress of at-risk students by no later than December |
16 | | 31 15 of
each year beginning the year after the initial report |
17 | | is submitted.
