AMENDMENT TO SENATE BILL 1388

2    AMENDMENT NO. ______. Amend Senate Bill 1388 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 11-303 and 11-304 as follows:
 
6    (625 ILCS 5/11-303)  (from Ch. 95 1/2, par. 11-303)
7    Sec. 11-303. The Department to place signs on all State
8highways.
9    (a) The Department shall place and maintain such
10traffic-control devices, conforming to its manual and
11specifications on all highways under its jurisdiction as it
12shall deem necessary to indicate and to carry out the
13provisions of this Chapter or to regulate, warn or guide
14traffic. These traffic control devices shall include temporary
15stop signs placed as a substitute for missing or damaged
16permanent stop signs required by the State Manual. Temporary

1stop signs shall be placed in a manner to provide adequate
2visibility and legibility, and shall be placed within duration
3recommendations in the State Manual, unless circumstances
4require longer placement.
5    (b) No local authority shall place or maintain any
6traffic-control device upon any highway under the jurisdiction
7of the Department except by the latter's permission.
8    (c) The Department shall erect and maintain guide, warning
9and direction signs upon highways in cities, towns and villages
10of which portions or lanes of such highways are under the
11control and jurisdiction of the Department or for which the
12Department has maintenance responsibility.
13    (d) Nothing in this Chapter shall divest the corporate
14authorities of park districts of power to prohibit or restrict
15the use of highways under their jurisdiction by certain types
16or weights of motor vehicles or the power of cities, villages,
17incorporated towns and park districts to designate highways for
18one-way traffic or the power of such municipal corporations to
19erect and maintain appropriate signs respecting such uses.
20    (e) Nothing in this Section shall prohibit a municipality,
21township, or county from erecting signs as required under the
22Illinois Adopt-A-Highway Act.

2    Local authorities in their respective maintenance
3jurisdiction shall place and maintain such traffic-control
4devices, including temporary stop signs placed as a substitute
5for missing or damaged permanent stop signs required by the
6State Manual, upon highways under their maintenance
7jurisdiction as are required to indicate and carry out the
8provisions of this Chapter, and local traffic ordinances or to
9regulate, warn, or guide traffic. All such traffic control
10devices shall conform to the State Manual and Specifications
11and shall be justified by traffic warrants stated in the
12Manual. Temporary stop signs shall be placed in a manner to
13provide adequate visibility and legibility, and shall be placed
14within duration recommendations in the State Manual, unless
15circumstances require longer placement. Placement of
16traffic-control devices on township or road district roads also
17shall be subject to the written approval of the county engineer
18or superintendent of highways.
19    Local authorities in their respective maintenance
20jurisdictions shall have the authority to install signs, in
21conformance with the State Manual and specifications, alerting
22motorists of the tourist oriented businesses available on roads
23under local jurisdiction in rural areas as may be required to
24guide motorists to the businesses. The local authorities and
25road district highway commissioners shall also have the
26authority to sell or lease space on these signs to the owners

1or operators of the businesses.
