1 | | AN ACT concerning transportation.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by changing |
5 | | Sections 11-303 and 11-304 as follows:
|
6 | | (625 ILCS 5/11-303) (from Ch. 95 1/2, par. 11-303)
|
7 | | Sec. 11-303. The Department to place signs on all State |
8 | | highways.
|
9 | | (a) The Department shall place and maintain such |
10 | | traffic-control
devices, conforming to its manual and |
11 | | specifications on all highways
under its jurisdiction as it |
12 | | shall deem necessary to indicate and to
carry out the |
13 | | provisions of this Chapter or to regulate, warn or guide |
14 | | traffic. These traffic control devices shall include temporary |
15 | | stop signs placed as a substitute for missing or damaged |
16 | | permanent stop signs required by the State Manual. Temporary |
17 | | stop signs shall be placed in a manner to provide adequate |
18 | | visibility and legibility, and shall be placed within duration |
19 | | recommendations in the State Manual, unless circumstances |
20 | | require longer placement.

21 | | (b) No local authority shall place or maintain any |
22 | | traffic-control
device upon any highway under the jurisdiction |
23 | | of the Department except
by the latter's permission.

1 | | (c) The Department shall erect and maintain guide, warning |
2 | | and
direction signs upon highways in cities, towns and villages |
3 | | of which
portions or lanes of such highways are under the |
4 | | control and
jurisdiction of the Department or for which the |
5 | | Department has
maintenance responsibility.
|
6 | | (d) Nothing in this Chapter shall divest the corporate |
7 | | authorities
of park districts of power to prohibit or restrict |
8 | | the use of highways
under their jurisdiction by certain types |
9 | | or weights of motor vehicles
or the power of cities, villages, |
10 | | incorporated towns and park districts
to designate highways for |
11 | | one-way traffic or the power of such municipal
corporations to |
12 | | erect and maintain appropriate signs respecting such
uses.

13 | | (e) Nothing in this Section shall prohibit a municipality, |
14 | | township, or
county from erecting signs as required under the |
15 | | Illinois Adopt-A-Highway Act.

and local traffic ordinances or to |
2 | | regulate, warn, or guide traffic. All
such traffic control |
3 | | devices shall conform to the State Manual and
Specifications |
4 | | and shall be justified by traffic warrants stated in the
|
5 | | Manual. Temporary stop signs shall be placed in a manner to |
6 | | provide adequate visibility and legibility, and shall be placed |
7 | | within duration recommendations in the State Manual, unless |
8 | | circumstances require longer placement. Placement of |
9 | | traffic-control devices on township or road district
roads also |
10 | | shall be subject to the written approval of the county engineer
|
11 | | or superintendent of highways.
|
12 | | Local authorities in their
respective maintenance |
13 | | jurisdictions shall have the authority to install signs,
in |
14 | | conformance with the State Manual and specifications, alerting |
15 | | motorists of
the tourist oriented businesses available on roads |
16 | | under
local jurisdiction in rural areas as may be required to |
17 | | guide motorists to the
businesses.
The local authorities and |
18 | | road district
highway commissioners shall also have the |
19 | | authority to sell or
lease space on these signs to the owners |
20 | | or operators of the businesses.
