SYNOPSIS AS INTRODUCED:

    Amends the Illinois Vehicle Code. Provides for the placement of temporary stop signs on State and local highways as a substitute for a missing or damaged permanent stop sign. Requires that every temporary stop sign shall conform to the requirements in the State Manual and Specifications. Requires that every temporary stop sign placed on a highway shall be a minimum of 6 feet in height, and shall be in place for no more 2 weeks, except in cases of emergency.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 11-303 and 11-304 as follows:
 
6    (625 ILCS 5/11-303)  (from Ch. 95 1/2, par. 11-303)
7    Sec. 11-303. The Department to place signs on all State
8highways.
9    (a) The Department shall place and maintain such
10traffic-control devices, including temporary stop signs placed
11as a substitute for a missing or damaged permanent stop sign,
12conforming to its manual and specifications on all highways
13under its jurisdiction as it shall deem necessary to indicate
14and to carry out the provisions of this Chapter or to regulate,
15warn or guide traffic.
16    (a-5) Every temporary stop sign placed under this Section
17shall be located as near as practicable to the nearest line of
18the crosswalk on the near side of the intersection or, if there
19is no crosswalk, then as close as practicable to the nearest
20line of the intersecting roadway. Temporary stop signs placed
21on highways under this Section shall be a minimum of 6 feet in
22height, and shall be in place for no more than 2 weeks, except
23in cases of emergency when circumstances require longer

1placement.
2    (b) No local authority shall place or maintain any
3traffic-control device upon any highway under the jurisdiction
4of the Department except by the latter's permission.
5    (c) The Department shall erect and maintain guide, warning
6and direction signs upon highways in cities, towns and villages
7of which portions or lanes of such highways are under the
8control and jurisdiction of the Department or for which the
9Department has maintenance responsibility.
10    (d) Nothing in this Chapter shall divest the corporate
11authorities of park districts of power to prohibit or restrict
12the use of highways under their jurisdiction by certain types
13or weights of motor vehicles or the power of cities, villages,
14incorporated towns and park districts to designate highways for
15one-way traffic or the power of such municipal corporations to
16erect and maintain appropriate signs respecting such uses.
17    (e) Nothing in this Section shall prohibit a municipality,
18township, or county from erecting signs as required under the
19Illinois Adopt-A-Highway Act.

24    Local authorities in their respective maintenance

1devices, including temporary stop signs placed as a substitute
2for a missing or damaged permanent stop sign, upon highways
3under their maintenance jurisdiction as are required to
4indicate and carry out the provisions of this Chapter, and
5local traffic ordinances or to regulate, warn, or guide
6traffic. All such traffic control devices shall conform to the
7State Manual and Specifications and shall be justified by
8traffic warrants stated in the Manual. Every temporary stop
9sign placed under this Section shall be located as near as
10practicable to the nearest line of the crosswalk on the near
11side of the intersection or, if there is no crosswalk, then as
12close as practicable to the nearest line of the intersecting
13roadway. Temporary stop signs placed on highways under this
14Section shall be a minimum of 6 feet in height, and shall be in
15place for no more than 2 weeks, except in cases of emergency
16when circumstances require longer placement. Placement of
17traffic-control devices on township or road district roads also
18shall be subject to the written approval of the county engineer
19or superintendent of highways.
20    Local authorities in their respective maintenance
21jurisdictions shall have the authority to install signs, in
22conformance with the State Manual and specifications, alerting
23motorists of the tourist oriented businesses available on roads
24under local jurisdiction in rural areas as may be required to
25guide motorists to the businesses. The local authorities and
26road district highway commissioners shall also have the

1authority to sell or lease space on these signs to the owners
2or operators of the businesses.
