1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-676 as follows:
 
7    (20 ILCS 2310/2310-676 new)
8    Sec. 2310-676. Neonatal Abstinence Syndrome Advisory
9Committee.
10    (a) As used in this Section:
11    "Department" means the Department of Public Health.
12    "Director" means the Director of Public Health.
13    "Neonatal Abstinence Syndrome" or "NAS" means various
14adverse conditions that occur in a newborn infant who was
15exposed to addictive or prescription drugs while in the
16mother's womb.
17    (b) There is created the Advisory Committee on Neonatal
18Abstinence Syndrome. The Advisory Committee shall consist of up
19to 10 members appointed by the Director of Public Health. The
20Director shall make the appointments within 90 days after the
21effective date of this amendatory Act of the 99th General
22Assembly. Members shall receive no compensation for their
23services. The members of the Advisory Committee shall represent

1different racial, ethnic, and geographic backgrounds and
2consist of:
3        (1) at least one member representing a statewide
4    association of hospitals;
5        (2) at least one member representing a statewide
6    organization of pediatricians;
7        (3) at least one member representing a statewide
8    organization of obstetricians;
9        (4) at least one member representing a statewide
10    organization that advocates for the health of mothers and
11    infants;
12        (5) at least one member representing a statewide
13    organization of licensed physicians;
14        (6) at least one member who is a licensed practical
15    nurse, registered professional nurse, or advance practice
16    nurse with expertise in the treatment of newborns in
17    neonatal intensive care units;
18        (7) at least one member representing a local or
19    regional public health agency; and
20        (8) at least one member with expertise in the treatment
21    of drug dependency and addiction.
22    (c) In addition to the membership in subsection (a) of this
23Section, the following persons or their designees shall serve
24as ex officio members of the Advisory Committee: the Director
25of Public Health, the Secretary of Human Services, the Director
26of Healthcare and Family Services, and the Director of Children

1and Family Services. The Director of Public Health, or his or
2her designee, shall serve as Chair of the Committee.
3    (d) The Advisory Committee shall meet at the call of the
4Chair. The Committee shall meet at least 3 times each year and
5its initial meeting shall take place within 120 days after the
6effective date of this Act. The Advisory Committee shall advise
7and assist the Department to:
8        (1) develop an appropriate standard clinical
9    definition of "NAS";
10        (2) develop a uniform process of identifying NAS;
11        (3) develop protocols for training hospital personnel
12    in implementing an appropriate and uniform process for
13    identifying and treating NAS;
14        (4) identify and develop options for reporting NAS data
15    to the Department by using existing or new data reporting
16    options; and
17        (5) make recommendations to the Department on
18    evidence-based guidelines and programs to improve the
19    outcomes of pregnancies with respect to NAS.
20    (e) The Advisory Committee shall provide an annual report
21of its activities and recommendations to the Director, the
22General Assembly, and the Governor by March 31 of each year
23beginning in 2016. The final report of the Advisory Committee
24shall be submitted by March 31, 2019.
25    (f) This Section is repealed on June 30, 2019.
 
26    Section 99. Effective date. This Act takes effect upon
